 1        AN  ACT  to  amend  the  Public Utilities Act by changing
 2    Section 9-250 and adding Section 9-250.5.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.  The  Public  Utilities  Act  is  amended  by
 6    changing  Section  9-250  and  by  adding  Section 9-250.5 as
 7    follows:

 8        (220 ILCS 5/9-250) (from Ch. 111 2/3, par. 9-250)
 9        Sec.  9-250.  Rates  and  charges  found  to  be  unjust.
10    Whenever the Commission, after a hearing  had  upon  its  own
11    motion  or upon complaint, shall find that the rates or other
12    charges,  or  classifications,  or  any  of  them,  demanded,
13    observed, charged or collected by any public utility for  any
14    service  or product or commodity, or in connection therewith,
15    or that the rules, regulations, contracts,  or  practices  or
16    any  of  them,  affecting  such  rates  or  other charges, or
17    classifications, or any of them,  are  unjust,  unreasonable,
18    discriminatory or preferential, or in any way in violation of
19    any provisions of law, or that such rates or other charges or
20    classifications   are   insufficient,  the  Commission  shall
21    determine the just, reasonable or sufficient rates  or  other
22    charges,  classifications,  rules,  regulations, contracts or
23    practices to be thereafter observed and in force,  and  shall
24    fix  the  same  by order as hereinafter provided. Any rate or
25    schedule of rates of a carrier that imposes a minimum monthly
26    fee for interMSA toll services for  customers  who  have  not
27    signed  up for any optional calling plan offered by a carrier
28    shall  be  deemed  by  the  Commission  not  to  be  just  or
29    reasonable because of the adverse impact those fees  have  on
30    customers who make few or no interMSA calls.
31        The Commission shall have power, upon a hearing, had upon

 1    its  own  motion  or  upon complaint, to investigate a single
 2    rate  or  other  charge,  classification,  rule,  regulation,
 3    contract or practice, or any number thereof,  or  the  entire
 4    schedule   or   schedules   of   rates   or   other  charges,
 5    classifications, rules, regulations, contracts and practices,
 6    or any thereof of any public utility, and  to  establish  new
 7    rates  or other charges, classifications, rules, regulations,
 8    contracts or practices or  schedule  or  schedules,  in  lieu
 9    thereof.

12        Sec.   9.250.5.  InterMSA   and   intraMSA   rates.   The
13    Commission shall have the power upon its own motion  or  upon
14    complaint to investigate and determine that any rates charged
15    by  an  interexchange  carrier  for  intrastate  interMSA and
16    intraMSA local toll calls  are  unjust  and  unreasonable  if
17    those  rates  do  not  reflect all reductions effective on or
18    after the effective date of this amendatory Act of  the  91st
19    General  Assembly  in  carrier  access  charges  paid  by the
20    interexchange carrier.
