1 AN ACT to amend the Video Movie Sales and Rentals Act by
2 adding Section 3.5 and changing Section 4.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Video Movie Sales and Rentals Act is
6 amended by adding Section 3.5 and changing Section 4 as
7 follows:
8 (720 ILCS 395/3.5 new)
9 Sec. 3.5. Sell or rent to a child. A person may not
10 sell at retail or rent, or attempt to sell at retail or rent,
11 a video movie to a child below the age of 18 years if the
12 official rating of the motion picture from which the video
13 movie was copied recommends that such child not be allowed to
14 attend the motion picture at a movie theater unless
15 accompanied by a parent or adult guardian. If no official
16 rating exists, a person may not sell at retail or rent, or
17 attempt to sell at retail or rent, the video movie to a child
18 below the age of 18 years unless the person has obtained the
19 written consent of the child's parent or guardian.

21 Sec. 4. Penalty.
22 (a) Any person who sells or rents, or attempts to sell
23 or rent, a video movie in violation of Section 3 of this Act
24 shall be guilty of a Class C misdemeanor.
25 (b) Any person who sells or rents, or attempts to sell
26 or rent, a video movie in violation of Section 3.5 of this
27 Act shall be guilty of a petty offense, with a fine of not
28 more than $100, for a first offense and a Class C misdemeanor
29 for a second or subsequent offense.
