1 AN ACT to amend the Public Utilities Act by changing
2 Section 13-403.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Public Utilities Act is amended by
6 changing Section 13-403 as follows:

8 (Section scheduled to be repealed on July 1, 2001)
9 Sec. 13-403. Interexchange service authority; approval.
10 The Commission shall approve an application for a Certificate
11 of Interexchange Service Authority only upon a showing by the
12 applicant, and a finding by the Commission, after notice and
13 hearing, that the applicant possesses sufficient technical,
14 financial and managerial resources and abilities to provide
15 interexchange telecommunications service. Where a previously
16 certified carrier undergoes a corporate reorganization that
17 is not subject to the provisions of Article VII of this Act,
18 and the previously certified carrier notifies the Commission
19 that as a result of the corporate reorganization a new
20 carrier will be providing the services for which the previous
21 carrier was certified, the Commission shall, without hearing,
22 transfer the previously granted certificate to the new
23 carrier within thirty days from the day the previously
24 certified carrier notifies the Commission of the
25 reorganization. The removal from this Section of the dialing
26 restrictions by this amendatory Act of 1992 does not create
27 any legislative presumption for or against intra-Market
28 Service Area presubscription or changes in intra-Market
29 Service Area dialing arrangements related to the
30 implementation of that presubscription, but simply vests
31 jurisdiction in the Illinois Commerce Commission to consider

1 after notice and hearing the issue of presubscription in
2 accordance with the policy goals outlined in Section 13-103.
3 The Commission shall have authority to alter the
4 boundaries of Market Service Areas when such alteration is
5 consistent with the public interest and the purposes and
6 policies of this Article. A determination by the Commission
7 with respect to Market Service Area boundaries shall not
8 modify or affect the rights or obligations of any
9 telecommunications carrier with respect to any consent decree
10 or agreement with the United States Department of Justice,
11 including, but not limited to, the Modification of Final
12 Judgment in United States v. Western Electric Co., 552 F.
13 Supp. 131 (D.D.C. 1982), as modified from time to time.

15 Section 999. This Act shall take effect upon becoming
16 law.
