1 AN ACT to amend the Illinois Public Aid Code by adding
2 Section 12-4.36.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Public Aid Code is amended by
6 changing Section 12-4.36 as follows:
7 (305 ILCS 5/12-4.36 new)
8 Sec. 12-4.36. Domestic violence counseling pilot
9 program.
10 (a) The Department of Human Services shall establish an
11 on-site domestic violence counseling pilot program in county
12 department offices.
13 (b) The pilot program must make domestic violence
14 counseling services available to applicants for and
15 recipients of public aid. The Department shall take
16 appropriate measures to ensure that applicants and recipients
17 in the pilot program counties receive adequate notice of the
18 services' availability.
19 (c) An applicant or recipient's participation in the
20 pilot program must be voluntary.
21 (d) The Department must establish a pilot program under
22 this Section in each of 3 counties as follows:
23 (1) One pilot program in Cook County.
24 (2) One pilot program in a county that is
25 contiguous to Cook County.
26 (3) One pilot program in a county that is not
27 described in item (1) or (2).
28 (e) The Secretary of Human Services, in his or her
29 discretion and in consultation with the county department of
30 a county in which the pilot program is established under this
31 Section, may direct that the pilot program be administered by

1 the county department. As part of its administrative
2 responsibilities under this subsection, a county department
3 must do all of the following:
4 (1) Maintain a database of appropriate providers of
5 domestic violence counseling services.
6 (2) Contract for domestic violence counseling
7 services to be provided under the pilot program.
8 (3) Compile necessary fiscal reports on the pilot
9 program.
