 1        AN ACT to amend the Illinois Grant Funds Recovery Act.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Illinois  Grant  Funds Recovery Act is
 5    amended by changing Section 5 as follows:

 6        (30 ILCS 705/5) (from Ch. 127, par. 2305)
 7        Sec. 5.   Time  limit  on  expenditure  of  grant  funds.
 8    Subject to the restriction of Section 35 of the State Finance
 9    Act  "An Act in relation to State finance", approved June 10,
10    1919, as amended, no grant funds may be  made  available  for
11    expenditure  by a grantee for a period longer than 4 years, 2
12    years except where the such  grant  funds  are  disbursed  in
13    reimbursement  of  costs  previously incurred by the grantee.
14    Any grant funds not expended or legally obligated by the  end
15    of  the  grant  agreement,  or  during the time limitation to
16    grant fund expenditures set forth in this  Section,  must  be
17    returned  to  the grantor agency within 45 days, if the funds
18    are not already on deposit with the  grantor  agency  or  the
19    State Treasurer.  Such returned funds shall be deposited into
20    the  fund  from  which the original grant disbursement to the
21    grantee was made.
22        At the request of the grantee under any  grant  agreement
23    with  the  Capital Development Board that is in effect on the
24    effective date of this amendatory Act  of  the  91st  General
25    Assembly,  the  Board shall amend the agreement to extend any
26    2-year spending, obligation, or completion deadline  included
27    in  the  agreement  for  an additional 2 years to reflect the
28    change made to this Section by this amendatory Act.
