1 AN ACT to amend the Environmental Protection Act by
2 adding Section 21.7.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Environmental Protection Act is amended by
6 adding Section 21.7 as follows:
7 (415 ILCS 5/21.7 new)
8 Sec. 21.7. Disposal of abandoned railroad ties.
9 (a) Not later than 180 days after railroad ties owned by
10 a railroad company become abandoned, the railroad company
11 must recycle or destroy the abandoned railroad ties. The
12 railroad company must retain ownership of the abandoned
13 railroad ties until they are recycled or destroyed.
14 (b) For purposes of this Section:
15 (1) Abandoned railroad ties are those that have
16 been removed from a railroad bed and are not suitable for
17 recycling or landscaping.
18 (2) "Railroad company" means any person, company,
19 corporation or association owning, operating or
20 constructing a railroad, a suburban or interurban
21 railroad, a switching or terminal railroad, a railroad
22 station, or a railroad bridge in this State.
23 (c) Violation of subsection (a) of this Section is a
24 petty offense.
25 Section 99. Effective date. This Act takes effect July 1,
26 2000.
