91_SB1507eng SB1507 Engrossed LRB9111142JMgc 1 AN ACT to amend the Illinois Commission on Community 2 Service Act. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Commission on Community Service 6 Act is amended by changing Sections 0.01, 1, 2, 3, 4, 5.1, 7 6.1, and 7 as follows: 8 (20 ILCS 710/0.01) (from Ch. 127, par. 3800) 9 Sec. 0.01. Short title. Creation. Purpose. The purpose of the Illinois Commission 20 on Volunteerism and Community Service is to promote and 21 support community service in public and private programs to 22 meet the needs of Illinois citizens; to stimulate new 23 volunteerism and community service initiatives and 24 partnerships; and to serve as a resource and advocate within 25 the Department of Human ServicesCommerce and Community26Affairsfor community service agencies, volunteers, and 27 programs which utilize State and private volunteers. 28 (Source: P.A. 88-597; 89-84, eff. 7-1-95.) Definitions. 3 "Commission" means the Illinois Commission on 4 Volunteerism and Community Service. 5 "Director" means the Executive Director of the Illinois 6 Commission on Volunteerism and Community Service. 7 "Staff" means the Illinois Commission on Volunteerism and 8 Community Service staff. 9 (Source: P.A. 88-597; 89-84, eff. 7-1-95.) 10 (20 ILCS 710/4) (from Ch. 127, par. 3804) 11 Sec. 4. Operation. TheLieutenantGovernor shall 12 appoint a Director of theLieutenant Governor'sCommission on 13 Volunteerism and Community Service who shall serve at the 14LieutenantGovernor's pleasure and who shall receive such 15 compensation as is determined by theLieutenantGovernor. 16 The Director shall employ such staff as is necessary to carry 17 out the purpose of this Act. The Commission, working in 18 cooperation with State agencies, individuals, local groups, 19 and organizations throughout the State, may undertake 20 programs and activities which further the purposes of this 21 Act including, but not limited to, the following: 22 (a) providing technical assistance to programs 23 which depend upon volunteers; 24 (b) initiating community service programs to meet 25 previously unmet needs in Illinois; 26 (c) promoting and coordinating efforts to expand 27 and improve the statewide community service network; 28 (d) recognizing outstanding community service 29 accomplishments; 30 (e) disseminating information to support community 31 service programs and to broaden community service 32 involvement throughout the State; 33 (f) implementing federally funded grant programs in SB1507 Engrossed -3- LRB9111142JMgc 1 Illinois such as the National and Community Service Trust 2 Act. 3 The Commission may receive and expend funds, grants and 4 services from any source for purposes reasonable and 5 necessary to carry out a coordinated plan of community 6 service throughout the State. 7 (Source: P.A. 87-902; 88-597, eff. 1-9-95.) 8 (20 ILCS 710/5.1) 9 Sec. 5.1. Commission. The Commission is established to 10 encourage community service and volunteer participation as a 11 means of community and State problem-solving; to promote and 12 support voluntary citizen involvement in government and 13 private programs throughout the State; to develop a 14 long-term, comprehensive vision and plan of action for 15 national volunteerism and community service initiatives in 16 Illinois; and to serve as the State's liaison to national and 17 State organizations that support its mission. 18 The Commission shall consist of 15 to 25 bipartisan 19 voting members and up to 15 bipartisan nonvoting members. At 20 least 25% of the members must be from the City of Chicago. 21 The Governor shall appoint up to 25 voting members and up 22 to 15 nonvoting members. Of those initial 25 voting 23 members, 10 shall serve for 3 years, 8 shall serve for 2 24 years, and 7 shall serve for one year. Voting members 25 appointed by the Governor shall include at least one 26 representative of the following: an expert in the education, 27 training, and development needs of youth; the chairman of the 28 City Colleges of a municipality having a population of more 29 than 2 million; labor organizations; business; the human 30 services department of a municipality with a population of 31 more than 2 million; community based organizations; the State 32 Superintendent of Education; the Superintendent of Police of 33 a municipality having a population of more than 2 million; a SB1507 Engrossed -4- LRB9111142JMgc 1 youth between 16 and 25 years old who is a participant or 2 supervisor in a community service program; the President of a 3 County Board of a county having a population of more than 3 4 million; an expert in older adult volunteerism; the public 5 health commissioner of a municipality having a population of 6 more than 2 million; local government; and a national service 7 program. A representative of; andthe federal Corporation 8 for National Service shall be appointed as a nonvoting 9 member. 10 Appointing authorities shall ensure, to the maximum 11 extent practicable, that the Commission is diverse with 12 respect to race, ethnicity, age, gender, geography, and 13 disability. Not more than 50% of the Commission appointed by 14 the Governor may be from the same political party. 15 Subsequent voting members of the Commission shall serve 16 3-year terms. Commissioners must be allowed to serve until 17 new commissioners are appointed in order to maintain the 18 federally required number of commissioners. 19 Each nonvoting member shall serve at the pleasure of the 20 Governor. 21 Members of the Commission may not serve more than 3222 consecutive terms. Vacancies shall be filled in the same 23 manner as the original appointments and any member so 24 appointed shall serve during the remainder of the term for 25 which the vacancy occurred. The members shall not receive 26 any compensation but shall be reimbursed for necessary 27 expenses incurred in the performance of their duties. 28 (Source: P.A. 88-597, eff. 1-9-95.) 29 (20 ILCS 710/6.1) 30 Sec. 6.1. Functions of Commission. The Commission shall 31 meet at least quarterly and shall advise and consult with the 32 Department of Human ServicesCommerce and Community Affairs33 and the Director on all matters relating to community service SB1507 Engrossed -5- LRB9111142JMgc 1 in Illinois. In addition, the Commission shall have the 2 following duties: 3 (a) prepare a 3-year national and community service 4 plan, developed through an open, public process and updated 5 annually; 6 (b) prepare the financial assistance applications of the 7 State under the National and Community Service Trust Fund Act 8 of 1993; 9 (c) assist in the preparation of the application by the 10 State Board of Education for assistance under that Act; 11 (d) prepare the State's application under that Act for 12 the approval of national service positions; 13 (e) assist in the provision of health care and child 14 care benefits under that Act; 15 (f) develop a State recruitment, placement, and 16 information dissemination system for participants in programs 17 that receive assistance under the national service laws; 18 (g) administer the State's grant program including 19 selection, oversight, and evaluation of grant recipients; 20 (h) make technical assistance available to enable 21 applicants to plan and implement service programs and to 22 apply for assistance under the national service laws; 23 (i) develop projects, training methods, curriculum 24 materials, and other activities related to service; 25 (j) coordinate its functions with any division of the 26 federal Corporation for National and Community Service 27 outlined in the National and Community Service Trust Fund Act 28 of 1993. 29 (k) publicize CommissionOfficeservices and promote 30 community involvement in the activities of the Commission 31Office; 32 (l) promote increased visibility and support for 33 volunteers of all ages, especially youth and senior citizens, 34 and community service in meeting the needs of Illinois SB1507 Engrossed -6- LRB9111142JMgc 1 citizens; and 2 (m) represent the Department of Human ServicesCommerce3and Community Affairson such occasions and in such manner as 4 the Departmentof Commerce and Community Affairsmay provide. 5 (Source: P.A. 88-597; 89-84, eff. 7-1-95.) 6 (20 ILCS 710/7) 7 Sec. 7. On the effective date of this amendatory Act of 8 the 91st General Assembly1995, the authority, powers, and 9 duties in this Act ofthe Lieutenant Governor are transferred10tothe Department of Commerce and Community Affairs are 11 transferred to the Department of Human Services. 12 (Source: P.A. 89-84, eff. 7-1-95.) 13 Section 10. The Illinois Commission on Community Service 14 Act is amended by changing the title as follows: 15 (20 ILCS 710/Act title) 16 An Act to create a Commission on Volunteerism and 17 Community Service and to define its powers and duties. 18 (Source: P.A. 86-1192. The Illinois Commission on Community Service 22 Act is amended by repealing Section 10. 23 Section 99. Effective date. This Act takes effect upon 24 becoming law.
