 1                    AMENDMENT TO SENATE BILL 1143

 2        AMENDMENT NO.     .  Amend Senate Bill 1143 on page 1, by
 3    replacing line 2 with the following:
 4    "changing Sections 5-8-1, 5-8A-3, and 5-8A-5."; and

 5    on page 1, by replacing line 6 with the following:
 6    "changing Sections 5-8-1, 5-8A-3, and  5-8A-5  as  follows:";
 7    and

 8    on page 5, line 22, by deleting "and"; and

 9    on page 5, by deleting line 23; and

10    on page 5, line 24, by deleting "(d)"; and

11    on  page 6, lines 4 and 5, by deleting "and a term of natural
12    life imprisonment is not imposed"; and

13    on page 6, line 7, by inserting "at least" after "5  years,";
14    and

15    on  page  6,  lines  11  and  12,  by deleting "and a term of
16    natural life imprisonment is not imposed"; and

17    on page 6, line 14, by inserting "at least" after "4 years,";
18    and

19    on page 9, line 2, by inserting "at least" after "for"; and

 1    on page 9, by inserting below line 6 the following:

 2        "(730 ILCS 5/5-8A-5) (from Ch. 38, par. 1005-8A-5)
 3        Sec.  5-8A-5.   Consent  of  the   participant.    Before
 4    entering   an   order  for  commitment  for  electronic  home
 5    detention,  the  supervising  authority  shall   inform   the
 6    participant  and  other  persons  residing in the home of the
 7    nature and  extent  of  the  approved  electronic  monitoring
 8    devices by doing the following:
 9        (A)  Securing  the  written consent of the participant in
10    the program to comply with the rules and regulations  of  the
11    program  as  stipulated  in  subsections  (A)  through (I) of
12    Section 5-8A-4.
13        (B)  Where possible,  securing  the  written  consent  of
14    other  persons  residing  in  the  home  of  the participant,
15    including  the  person  in  whose  name  the   telephone   is
16    registered,  at  the  time  of  the  order  or commitment for
17    electronic home detention  is  entered  and  acknowledge  the
18    nature and extent of approved electronic monitoring devices.
19        (C)  Insure  that  the  approved  electronic  devices  be
20    minimally  intrusive  upon the privacy of the participant and
21    other  persons  residing  in  the  home  while  remaining  in
22    compliance  with  subsections  (B)  through  (D)  of  Section
23    5-8A-4.
24        (D)  This Section does not apply to  persons  subject  to
25    Electronic  Home  Monitoring as a term or condition of parole
26    or mandatory  supervised  release  under  subsection  (d)  of
27    Section 5-8-1 of this Code.
