 1                    AMENDMENT TO SENATE BILL 1104

 2        AMENDMENT NO.     .  Amend Senate Bill 1104 by  replacing
 3    the title with the following:
 4        "AN  ACT to amend the Carnival and Amusement Rides Safety
 5    Act."; and

 6    by replacing everything after the enacting  clause  with  the
 7    following:

 8        "Section  5.  The Carnival and Amusement Rides Safety Act
 9    is amended by changing Section 2-6 as follows:

10        (430 ILCS 85/2-6) (from Ch. 111 1/2, par. 4056)
11        Sec. 2-6.  Promulgation of rules and regulations  by  the
12    Board;   public  hearing.  The  Board  shall  promulgate  and
13    formulate definitions, rules and  regulations  for  the  safe
14    installation,   repair,   maintenance,   use,  operation  and
15    inspection of all amusement rides and  amusement  attractions
16    as  the  Board  finds  necessary  for  the  protection of the
17    general  public   using   amusement   rides   and   amusement
18    attractions. The rules shall be based upon generally accepted
19    engineering  standards  and  shall be concerned with, but not
20    necessarily limited to, engineering  force  stresses,  safety
21    devices,  and preventive maintenance. Whenever such standards

 1    are available in suitable form they may  be  incorporated  by
 2    reference.  The  rules  shall  provide  for  the reporting of
 3    accidents  and  injuries  incurred  from  the  operation   of
 4    amusement  rides or amusement attractions. In addition to the
 5    permit fee herein provided, the Board may promulgate rules to
 6    establish a schedule of fees for inspections.
 7        Before  adopting,  modifying   or   amending   any   rule
 8    consistent  with  and  necessary  for the enforcement of this
 9    Act, the Director or Board shall hold a public hearing on the
10    proposed rule, modification or amendment  to  a    rule.  Any
11    interested  person may appear and be heard at the hearing, in
12    person or by agent or counsel. The Director  shall  give  the
13    news media notice of each hearing at least 30 days in advance
14    of  the  hearing  date and shall make available a copy of the
15    proposed rule, or modification or amendment to a rule to  any
16    person requesting same. The provisions of this Section are in
17    addition to all other existing requirements pertaining to the
18    promulgation of administrative rules and regulations.
