 1        AN ACT in relation to automatic contract renewal.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  1.   Short  title.  This Act may be cited as the
 5    Automatic Contract Renewal Act.

 6        Section 5.  Definition.  In this Act:
 7        "Contract" means a written agreement between  2  or  more
 8    parties.
 9        "Parties"  include  individuals and other legal entities,
10    but do not include the  federal  government,  this  State  or
11    another  state,  a  unit  of  local  government,  or a school
12    district.

13        Section  10.   Automatic  renewal;  requirements.   If  a
14    contract  is  subject  to  automatic  renewal,   the   clause
15    providing  for  automatic renewal must appear in the contract
16    in a clear and conspicuous manner.

17        Section 15.  Violation.  If a contract  does  not  comply
18    with  this  Act,  the  automatic  renewal  provisions are not
19    enforceable by a party who prepared the contract or  directed
20    its preparation.

21        Section 20.  Applicability.  This Act does not apply to a
22    contract entered into before the effective date of this Act.
