 1        AN ACT to amend the Firearm  Owners  Identification  Card
 2    Act by changing Sections 3.1 and 6.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Firearm Owners Identification Card Act is
 6    amended by changing Sections 3.1 and 6 as follows:

 7        (430 ILCS 65/3.1) (from Ch. 38, par. 83-3.1)
 8        Sec. 3.1. Dial up system. The Department of State  Police
 9    shall  provide a dial up telephone system which shall be used
10    by any federally licensed firearm dealer who is to transfer a
11    firearm under the provisions of this Act. The  Department  of
12    State  Police  shall utilize existing technology which allows
13    the caller to be charged a fee  equivalent  to  the  cost  of
14    providing  this service but not to exceed $2.  Fees collected
15    by the Department of State Police shall be deposited  in  the
16    State Police Services Fund and used to provide the service.
17        Upon  receiving  a  request  from  a  federally  licensed
18    firearm   dealer,   the  Department  of  State  Police  shall
19    immediately approve, or within the time period established by
20    Section 24-3 of the  Criminal  Code  of  1961  regarding  the
21    delivery  of  firearms,  notify  the  inquiring dealer of any
22    objection that would disqualify the transferee from acquiring
23    or possessing a  firearm.  In  conducting  the  inquiry,  the
24    Department  of  State  Police  shall initiate and complete an
25    automated search of its criminal history  record  information
26    files  and  those  of  the  Federal  Bureau of Investigation,
27    including the  National  Instant  Criminal  Background  Check
28    System,  and of the files of the Department of Human Services
29    relating to mental health and developmental  disabilities  to
30    obtain  any  felony  conviction  or  patient  hospitalization
31    information which would disqualify a person from obtaining or

 1    require  revocation  of  a  currently  valid  Firearm Owner's
 2    Identification Card.
 3        The Department of State Police must act as  the  Illinois
 4    Point of Contact for the National Instant Criminal Background
 5    Check System.
 6        The  Department of State Police shall promulgate rules to
 7    implement this system.

11        Sec.  6. A Firearm Owner's Identification Card, issued by
12    the Department of State Police at such places as the Director
13    of  the  Department  shall   specify,   shall   contain   the
14    applicant's  name,  residence,  date  of birth, sex, physical
15    description,  recent  photograph  and  such  other   personal
16    identifying  information  as may be required by the Director.
17    Each  Firearm  Owner's  Identification  Card  must  have  the
18    expiration date boldly and  conspicuously  displayed  on  the
19    face  of  the card.  Each Firearm Owner's Identification Card
20    issued  on  or  after  September  1,  1999  must  boldly  and
21    conspicuously  display  an  authorization  number  from   the
22    National  Instant  Criminal  Background  Check  System.  Each
23    Firearm Owner's Identification Card must have printed  on  it
24    the following: "CAUTION - This card does not permit bearer to
25    UNLAWFULLY carry or use firearms."

27        Section  99.  Effective date.  This Act takes effect upon
28    becoming law.
