 1        AN ACT to amend the  Criminal  Code  of  1961  by  adding
 2    Section 24-3.5.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Criminal  Code  of  1961  is  amended  by
 6    adding Section 24-3.5 as follows:

 7        (720 ILCS 5/24-3.5 new)
 8        Sec. 24-3.5.  Laser sight accessory prohibition.
 9        (a)  "Laser  sight  accessory"  means  a  laser  sighting
10    device  that is integrated into a firearm or capable of being
11    attached to a firearm.
12        (b)  It is unlawful to sell, offer or display  for  sale,
13    give,  lend,  transfer  ownership  of,  acquire, or possess a
14    laser sight accessory.
15        (c)  A person who violates this Section is  guilty  of  a
16    Class A misdemeanor.
17        (d)  This  Section does not apply to any of the following
18    persons to the extent that the person is otherwise authorized
19    to acquire or possess a laser sight accessory and  is  acting
20    within the scope of his or her duties:
21             (1)  peace officers; or
22             (2)  members of the Armed Services or Reserve Forces
23        of  the  United  States, the Illinois National Guard, the
24        Reserve Officers Training Corps, or an organized  militia
25        of another state.
26        (e)  Within  14  days  after  the  effective date of this
27    amendatory Act of the 91st General  Assembly,  a  person  may
28    voluntarily  and  peaceably  deliver  and  abandon  to  a law
29    enforcement officer a laser sight accessory before an  arrest
30    and  prosecution  of the person on a charge of violating this
31    Section with respect to the laser sight accessory voluntarily

 1    delivered.
 2        Delivery under this subsection (e) may be made at any law
 3    enforcement  agency  headquarters  or  by  summoning  a   law
 4    enforcement  officer  to  the  person's residence or place of
 5    business.
 6        The voluntary delivery or abandonment of  a  laser  sight
 7    accessory  after  an  arrest  or charge for violation of this
 8    Section shall not moot or in any manner invalidate the arrest
 9    or charge.
