1 AN ACT in relation to certain construction contracts.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the
5 Construction Contract Indemnification for Employee Injury
6 Act.
7 Section 5. Certain agreements unenforceable. With
8 respect to contracts or agreements, either public or private,
9 for the construction, alteration, repair, or maintenance of a
10 building, structure, highway bridge, viaducts, or other work
11 dealing with construction, or for any moving, demolition, or
12 excavation or environmental cleanup connected therewith,
13 every covenant, promise, or agreement to indemnify another
14 person against loss or injury to one's employee in excess of
15 the damages, compensation or benefits payable by or for the
16 employer under workers' compensation acts, disability benefit
17 acts, or other employee benefits acts actually paid or
18 payable for or on behalf of the employer is void as against
19 public policy and wholly unenforceable.
20 Section 10. Application of Act. This Act applies only to
21 contracts or agreements entered into after its effective
22 date.
23 Section 99. Effective date. This Act takes effect upon
24 becoming law.
