 1        AN ACT regarding forestry development and assistance.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Urban and Community  Forestry  Assistance
 5    Act is amended by changing Section 6 as follows:

 6        (30 ILCS 735/6) (from Ch. 96 1/2, par. 9306)
 7        Sec.  6.   Grants;  sources and amounts.  Urban/Community
 8    Forestry Assistance  Grants  shall  be  made  available  from
 9    appropriations   from  the  General  Revenue  Fund,  Illinois
10    Forestry Development Fund, or other sources  as  appropriated
11    by  the  General  Assembly.   The  grants shall be limited to
12    projects for which the applicant will provide at least 50% of
13    the cost.  A single grant to a unit of local government shall
14    not exceed 5% of the amount allocated for the  grant  program
15    by   the  Department  in  the  current  fiscal  year.     The
16    Department shall seek and obtain the advice of  the  Forestry
17    Development  Council  with  respect  to awarding grants under
18    this Section.
19        In the event that any of the municipality's  contribution
20    to  the  payment  of the cost of the program is to be made by
21    contribution of in kind service, the  application  shall  set
22    forth in detail how such contribution will be made.
23        Units   of   local   government   may   delegate  program
24    administration, including  the  receipt  and  expenditure  of
25    funds, to special boards by ordinance.

27        Section  10.   The  Illinois  Forestry Development Act is
28    amended by re-enacting and changing Section 6a as follows:

 1        (This Section had an internal repeal  date  of  12-31-98.
 2    Public  Act  90-809, which became law and took effect on that
 3    date, replaced 12-31-98 with 12-31-2008.)
 4        Sec. 6a. Illinois Forestry Development Council.
 5        (a)  The Illinois Forestry Development Council is  hereby
 6    recreated   by  this  amendatory  Act  of  the  91st  General
 7    Assembly.
 8        (b)  The Council shall consist of 24 members appointed as
 9    follows:
10             (1)  four  members  of  the  General  Assembly,  one
11        appointed by the President of the Senate,  one  appointed
12        by  the  Senate  Minority  Leader,  one  appointed by the
13        Speaker  of  the  House  of  Representatives,   and   one
14        appointed by the House Minority Leader;
15             (2)  one   member   appointed  by  the  Governor  to
16        represent the Governor;
17             (3)  the Directors of  the  Departments  of  Natural
18        Resources,   Agriculture,   and  Commerce  and  Community
19        Affairs, the Executive  Director  of  the  Illinois  Farm
20        Development  Authority, and the Director of the Office of
21        Rural Affairs, or their designees;
22             (4)  the chairman of the Department of Forestry or a
23        forestry  academician,   appointed   by   the   Dean   of
24        Agriculture    at   Southern   Illinois   University   at
25        Carbondale;
26             (5)  the head of the Department of Natural Resources
27        and Environmental Sciences  or  a  forestry  academician,
28        appointed by the Dean of Agriculture at the University of
29        Illinois;
30             (6)  two  members,  appointed  by  the Governor, who
31        shall be private timber growers;
32             (7)  one member, appointed by the president  of  the
33        Illinois Wood Products Association, who shall be involved
34        in primary forestry industry;

 1             (8)  one  member,  appointed by the president of the
 2        Illinois Wood Products Association, who shall be involved
 3        in secondary forestry industry;
 4             (9)  one  member  who  is   actively   involved   in
 5        environmental issues, appointed by the Governor;
 6             (10)  the  president  of the Association of Illinois
 7        Soil and Water Conservation Districts;
 8             (11)  two  persons  who  are  actively  engaged   in
 9        farming, appointed by the Governor;
10             (12)  one  member,  appointed by the Governor, whose
11        primary area of expertise is urban forestry;
12             (13)  one member appointed by the President  of  the
13        Illinois Arborists Association;
14             (14)  the  Supervisor of the Shawnee National Forest
15        and the United States Department of  Agriculture  Natural
16        Resource Conservation Service's State Conservationist, ex
17        officio, or their designees.
18        (c)  Members   of   the   Council   shall  serve  without
19    compensation but shall  be  reimbursed  for  actual  expenses
20    incurred  in  the  performance  of their duties which are not
21    otherwise reimbursed.
22        (d)  The Council  shall  select  from  its  membership  a
23    chairperson   and   such   other  officers  as  it  considers
24    necessary.
25        (e)  Other individuals, agencies and organizations may be
26    invited to participate as deemed advisable by the Council.
27        (f)  The Council shall study and  evaluate  the  forestry
28    resources  and  forestry  industry  of Illinois.  The Council
29    shall:
30             (1)  determine the magnitude, nature and  extent  of
31        the State's forestry resources;
32             (2)  determine   current  uses  and  project  future
33        demand for forest  products,  services  and  benefits  in
34        Illinois;

 1             (3)  determine    and    evaluate    the   ownership
 2        characteristics of the State's forests, the  motives  for
 3        forest  ownership and the success of incentives necessary
 4        to stimulate development of forest resources;
 5             (4)  determine   the   economic   development    and
 6        management   opportunities   that   could   result   from
 7        improvements   in   local  and  regional  forest  product
 8        marketing and from the establishment of new or additional
 9        wood-related businesses in Illinois;
10             (5)  confer  with  and  offer  assistance   to   the
11        Illinois  Farm  Development  Authority  relating  to  its
12        implementation  of  forest  industry  assistance programs
13        authorized by the Illinois Farm Development Act;
14             (6)  determine  the  opportunities  for   increasing
15        employment  and  economic  growth  through development of
16        forest resources;
17             (7)  determine the effect  of  current  governmental
18        policies  and  regulations on the management of woodlands
19        and the location of wood products markets;
20             (8)  determine the staffing and  funding  needs  for
21        forestry  and  other conservation programs to support and
22        enhance forest resources development;
23             (9)  determine  the  needs  of  forestry   education
24        programs in this State;
25             (10)  confer   with  and  offer  assistance  to  the
26        Department  of  Natural   Resources   relating   to   the
27        implementation   of   urban  forestry  assistance  grants
28        pursuant to the Urban and Community  Forestry  Assistance
29        Act; and
30             (11)  determine soil and water conservation benefits
31        and  wildlife  habitat enhancement opportunities that can
32        be promoted through approved forestry management plans.
33        (g)  The  Council  shall  report  (i)  its  findings  and
34    recommendations  for  future  State  action  and   (ii)   its

 1    evaluation  of  Urban/Community Forestry Assistance Grants to
 2    the General Assembly no later than July 1 of each year.
 3        (h)  This Section 6a is repealed December 31, 2008.

 6        Section 99.  Effective date.  This Act takes effect  upon
 7    becoming law.
