 1        AN ACT to amend the  Public  Utilities  Act  by  changing
 2    Section 13-505.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.   The  Public  Utilities  Act  is  amended  by
 6    changing Section 13-505 as follows:

 7        (220 ILCS 5/13-505) (from Ch. 111 2/3, par. 13-505)
 8        (Section scheduled to be repealed on July 1, 2001)
 9        Sec. 13-505.  Rate changes; competitive services.
10        (a)  Any  proposed  increase  or  decrease  in  rates  or
11    charges,  or  proposed change in any classification or tariff
12    resulting in an increase or decrease in rates or charges, for
13    a  competitive  telecommunications   service   shall   become
14    effective  30  days after be permitted upon the filing of the
15    proposed rate,  charge,  classification,  or  tariff.   Prior
16    notice  of  an  increase  shall  be  given to all potentially
17    affected  customers  by  mail  to  each  affected   customer,
18    publication   in  a  newspaper  of  general  circulation,  or
19    equivalent means of notice.
20        (b)  Any  proposed  decrease  in  rates  or  charges,  or
21    proposed change in any classification or tariff resulting  in
22    a   decrease   in   rates   or  charges,  for  a  competitive
23    telecommunications service shall be effective upon the filing
24    of the proposed rate, charge, classification, or tariff.
25        (c)(b)  If a hearing is held pursuant  to  Section  9-250
26    regarding  the  reasonableness of an increase in the rates or
27    charges of a competitive local  exchange  service,  then  the
28    telecommunications  carrier  providing the service shall have
29    the  burden  of  proof  to   establish   the   justness   and
30    reasonableness of the proposed rate or charge.
