 1                    AMENDMENT TO SENATE BILL 336

 2        AMENDMENT NO.     .  Amend Senate Bill 336  by  replacing
 3    the title with the following:
 4        "AN  ACT  to  amend  the  Bingo  License  and  Tax Act by
 5    changing Section 2."; and

 6    by replacing everything after the enacting  clause  with  the
 7    following:

 8        "Section  5.  The Bingo License and Tax Act is amended by
 9    changing Section 2 as follows:

10        (230 ILCS 25/2) (from Ch. 120, par. 1102)
11        Sec. 2.  The  conducting  of  bingo  is  subject  to  the
12    following restrictions:
13        (1)  The  entire  net  proceeds  from  bingo play must be
14    exclusively  devoted  to   the   lawful   purposes   of   the
15    organization permitted to conduct that game.
16        (2)  No   person   except  a  bona  fide  member  of  the
17    sponsoring organization or a bona fide member of an auxiliary
18    organization, substantially all of whose members are  spouses
19    of  members of the sponsoring organization may participate in
20    the management or operation of the game.
21        (3)  No person may receive any remuneration or profit for

 1    participating in the management or  operation  of  the  game,
 2    except  that  if  an  organization licensed under this Act is
 3    associated with a school or  other  educational  institution,
 4    that  school  or institution may reduce tuition or fees for a
 5    designated pupil based on participation in the management  or
 6    operation  of the game by any member of the organization. The
 7    extent to which tuition and fees  are  reduced  shall  relate
 8    proportionately  to  the  amount  of  time volunteered by the
 9    member, as determined by  the  school  or  other  educational
10    institution.
11        (4)  The  total retail value of all prizes or merchandise
12    awarded for a single game of bingo may not exceed $1,000. The
13    aggregate retail value of all prizes or  merchandise  awarded
14    in any single day of bingo may not exceed $6,000, except that
15    the  Department  may authorize a licensee to award prizes and
16    merchandise in a single day  that  has  an  aggregate  retail
17    value  that  exceeds $6,000 but does not exceed $10,000 on up
18    to 2 days per year. $2,250, except that in adjoining counties
19    having 200,000 to 275,000 inhabitants each, and  in  counties
20    which  are  adjacent to either of such adjoining counties and
21    are adjacent to a total of not more than 2 counties  in  this
22    State,   and   in  any  municipality  having  2,500  or  more
23    inhabitants  and  within  one  mile  of  such  adjoining  and
24    adjacent counties having  less  than  25,000  inhabitants,  2
25    additional  bingo  games  may  be  conducted after the $2,250
26    limit has been reached.  The prize awarded for any one  game,
27    including  any game conducted after reaching the $2,250 limit
28    as authorized in this paragraph (4), may not exceed $500 cash
29    or its equivalent.
30        (5)  The number of games may not exceed 25 in any one day
31    including  regular  and  special  games,  except  that   this
32    restriction  on  the number of games shall not apply to bingo
33    conducted at the Illinois State Fair or any county fair  held
34    in Illinois.

 1        (6)  The  price  paid for a single card under the license
 2    may not exceed $1 and such card  is  valid  for  all  regular
 3    games  on that day of bingo. A maximum of 5 special games may
 4    be held on each bingo day, except that  this  restriction  on
 5    the  number  of  special  games  shall  not  apply  to  bingo
 6    conducted  at the Illinois State Fair or any county fair held
 7    in Illinois. The price for a single special game card may not
 8    exceed 50 cents.
 9        (7)  The number of bingo days  conducted  by  a  licensee
10    under this Act is limited to one per week, except as follows:
11             (i)  Bingo  may  be conducted in accordance with the
12        terms of a special operator's permit or  limited  license
13        issued under subdivision (3) of Section 1.
14             (ii)  Bingo  may  be conducted at the Illinois State
15        Fair  or  any  county  fair  held   in   Illinois   under
16        subdivision (3) of Section 1.
17             (iii)  A  licensee  which  cancels  a  day  of bingo
18        because of inclement weather or  because  the  day  is  a
19        holiday  or the eve of a holiday may, after giving notice
20        to the Department, conduct bingo on  an  additional  date
21        which  falls  on  a  day  of  the week other than the day
22        authorized  under  the  license.    As   used   in   this
23        subdivision  (iii),  "holiday"  means any of the holidays
24        listed in Section 17 of  the  Promissory  Note  and  Bank
25        Holiday Act.
26        (8)  A  licensee  may rent a premises on which to conduct
27    bingo only from  an  organization  which  is  licensed  as  a
28    provider  of  premises  or  exempt  from license requirements
29    under this Act. If the organization providing the premises is
30    a metropolitan exposition, auditorium,  and  office  building
31    authority  created  by State law, a licensee may enter into a
32    rental  agreement  with  the  organization  authorizing   the
33    licensee  and the organization to share the gross proceeds of
34    bingo games; however, the organization shall not receive more

 1    than 50% of the gross proceeds.
 2        (9)  No person under the age of  18  years  may  play  or
 3    participate in the conducting of bingo.  Any person under the
 4    age  of  18 years may be within the area where bingo is being
 5    played only when accompanied by his parent or guardian.
 6        (10)  The promoter of bingo games must have a proprietary
 7    interest in the game promoted.
 8        (11)  Raffles or other forms of  gambling  prohibited  by
 9    law  shall  not  be  conducted on the premises where bingo is
10    being  conducted,  except  that  pull  tabs  and  jar   games
11    conducted  under the Illinois Pull Tabs and Jar Games Act may
12    be conducted on the premises where bingo is being  conducted.
13    Prizes  awarded  in  pull  tabs  and  jar  games shall not be
14    included in the bingo prize limitation.
15        (12)  An organization holding a special operator's permit
16    or a limited license may, as one of the occasions allowed  by
17    such  permit  or  license,  conduct  bingo for a maximum of 2
18    consecutive days, during each day  of  which  the  number  of
19    games may exceed 25, and regular game cards need not be valid
20    for  all  regular  games.  If only noncash prizes are awarded
21    during such occasions, the prize limits stated  in  paragraph
22    (4) of this Section shall not apply, provided that the retail
23    value  of noncash prizes for any single game shall not exceed
24    $150.
