 1        AN ACT to amend the Consumer Fraud and Deceptive Business
 2    Practices Act by adding Section 2JJ.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Consumer  Fraud  and  Deceptive  Business
 6    Practices Act is amended by adding Section 2JJ as follows:

 7        (815 ILCS 505/2JJ new)
 8        Sec.  2JJ.  Sales  of  telecommunications  services  on a
 9    prepaid basis.
10        (a)  Sales of telecommunications calling time by means of
11    a prepaid calling card may not include, as a condition of the
12    sale or contract for sale, that the  consumer  must  use  the
13    prepaid  calling  time  within a specified time period unless
14    the usage period is calculated from the date of first use  or
15    unless  the specific expiration date is disclosed on the face
16    of the card. This Section does not apply to calling time sold
17    for use by means of cellular telephones or to prepaid calling
18    cards provided on a promotional basis  to  consumers  without
19    charge.
20        (b)  As  used  in  this  Section,  "prepaid calling card"
21    means an instrument or device  issued  for  the  use  of  the
22    cardholder in obtaining telecommunications calling time.
23        (c)  A person who violates the provisions of this Section
24    commits  an unlawful practice within the meaning of this Act.
25    A person who violates the provisions of this Section  commits
26    a  business  offense may be fined not less than $501 nor more
27    than $5,000 for each offense.
