 1        AN ACT concerning prostate and testicular cancer.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Civil Administrative Code of Illinois  is
 5    amended by changing Section 55.90 as follows:

 6        (20 ILCS 2310/55.90)
 7        Sec.  55.90.   Prostate  and  testicular cancer awareness
 8    program.   The  Department  of  Public  Health,  subject   to
 9    appropriation   or   other   available   funding   and  funds
10    appropriated  from  the  Prostate   and   Testicular   Cancer
11    Awareness  Fund, shall conduct a program to promote awareness
12    and early detection of prostate and testicular  cancer.   The
13    program may include, but need not be limited to:
14             (1)  dissemination   of  information  regarding  the
15        incidence of prostate and  testicular  cancer,  the  risk
16        factors  associated  with prostate and testicular cancer,
17        and the benefits of early detection and treatment;
18             (2)  promotion of information and  counseling  about
19        treatment options; and
20             (3)  promotion  of  referral  services and screening
21        programs.

23        Section 10.  The State Finance Act is amended  by  adding
24    Section 5.490 as follows:

26        Sec. 5.490.  The Prostate and Testicular Cancer Awareness
27    Fund.

28        Section  15.   The  Illinois Income Tax Act is amended by

 1    adding Section 507U and changing  Sections  509  and  510  as
 2    follows:

 3        (35 ILCS 5/507U new)
 4        Sec. 507U.  Prostate and Testicular Cancer Awareness Fund
 5    checkoff.    Beginning  with taxable years ending on December
 6    31,  1999,  the  Department  must  print  on   its   standard
 7    individual income tax form a provision indicating that if the
 8    taxpayer  wishes to contribute to the Prostate and Testicular
 9    Cancer Awareness Fund as authorized by this amendatory Act of
10    the 91st General Assembly, he or she may do so by stating the
11    amount of the contribution (not less than $1) on  the  return
12    and  that  the contribution will reduce the taxpayer's refund
13    or increase the  amount  of  the  payment  to  accompany  the
14    return.   Failure  to  remit  any amount of increased payment
15    reduces the contribution accordingly.  This Section does  not
16    apply to an amended return.

18        Sec.  509.  Tax  checkoff  explanations.   All individual
19    income   tax   return   forms   shall   contain   appropriate
20    explanations and spaces to enable the taxpayers to  designate
21    contributions  to  the  Child  Abuse  Prevention Fund, to the
22    Community Health Center Care Fund, to the  Illinois  Wildlife
23    Preservation  Fund  as  required  by  the  Illinois  Non-Game
24    Wildlife  Protection Act, to the Alzheimer's Disease Research
25    Fund as required by the Alzheimer's Disease Research Act,  to
26    the  Assistance to the Homeless Fund as required by this Act,
27    to the Heritage Preservation Fund as required by the Heritage
28    Preservation Act, to the Child Care Expansion Program Fund as
29    required by the Child Care Expansion Program Act, to the Ryan
30    White  AIDS  Victims  Assistance  Fund,  to   the   Assistive
31    Technology   for  Persons  with  Disabilities  Fund,  to  the
32    Domestic Violence Shelter and Service  Fund,  to  the  United

 1    States  Olympians  Assistance  Fund,  to the Youth Drug Abuse
 2    Prevention Fund, to the Persian Gulf Conflict Veterans  Fund,
 3    to the Literacy Advancement Fund, to the Ryan White Pediatric
 4    and  Adult  AIDS  Fund,  to  the  Illinois  Special  Olympics
 5    Checkoff  Fund,  to  the  Breast and Cervical Cancer Research
 6    Fund, to the Korean War Memorial Fund, to the  Heart  Disease
 7    Treatment  and  Prevention  Fund, to the Hemophilia Treatment
 8    Fund, to the Mental Health Research Fund, to  the  Children's
 9    Cancer  Fund,  to  the American Diabetes Association Fund, to
10    the Women in Military Service Memorial Fund, to the  Prostate
11    and  Testicular  Cancer  Awareness  Fund, and to the Meals on
12    Wheels Fund. Each form shall contain  a  statement  that  the
13    contributions  will  reduce the taxpayer's refund or increase
14    the amount of payment to accompany the  return.   Failure  to
15    remit  any  amount  of  increased  payment  shall  reduce the
16    contribution accordingly.
17        If, on October 1 of any year, the total contributions  to
18    any  one  of  the  funds made under this Section do not equal
19    $100,000 or more, the explanations and spaces for designating
20    contributions  to  the  fund  shall  be  removed   from   the
21    individual  income tax return forms for the following and all
22    subsequent years and all subsequent contributions to the fund
23    shall be refunded to the taxpayer.

27        Sec.  510.  Determination  of  amounts  contributed.  The
28    Department shall determine the total  amount  contributed  to
29    each  of  the following: the Child Abuse Prevention Fund, the
30    Illinois Wildlife Preservation  Fund,  the  Community  Health
31    Center  Care  Fund,  the Assistance to the Homeless Fund, the
32    Alzheimer's Disease Research Fund, the Heritage  Preservation
33    Fund,  the  Child Care Expansion Program Fund, the Ryan White

 1    AIDS Victims Assistance Fund, the  Assistive  Technology  for
 2    Persons with Disabilities Fund, the Domestic Violence Shelter
 3    and  Service  Fund,  the  United  States Olympians Assistance
 4    Fund, the Youth Drug Abuse Prevention Fund, the Persian  Gulf
 5    Conflict  Veterans  Fund,  the Literacy Advancement Fund, the
 6    Ryan White  Pediatric  and  Adult  AIDS  Fund,  the  Illinois
 7    Special  Olympics  Checkoff  Fund,  the  Breast  and Cervical
 8    Cancer Research Fund, the Korean War Memorial Fund, the Heart
 9    Disease  Treatment  and  Prevention  Fund,   the   Hemophilia
10    Treatment   Fund,   the  Mental  Health  Research  Fund,  the
11    Children's Cancer Fund, the  American   Diabetes  Association
12    Fund,  the  Women  in  Military  Service  Memorial  Fund, the
13    Prostate and Testicular Cancer Awareness Fund, and the  Meals
14    on  Wheels  Fund;  and shall notify the State Comptroller and
15    the State Treasurer of the amounts to be transferred from the
16    General Revenue Fund to each fund, and upon receipt  of  such
17    notification   the  State  Treasurer  and  Comptroller  shall
18    transfer the amounts.

21        Section  99.  Effective date.  This Act takes effect upon
22    becoming law.
