 1                    AMENDMENT TO SENATE BILL 149

 2        AMENDMENT NO.     .  Amend Senate Bill 149  by  replacing
 3    the title with the following:
 4        "AN  ACT  to  amend the Emergency Telephone System Act by
 5    changing Section 15.6."; and

 6    by replacing everything after the enacting  clause  with  the
 7    following:

 8        "Section   5.  The  Emergency  Telephone  System  Act  is
 9    amended by changing Section 15.6 as follows:

10        (50 ILCS 750/15.6)
11        Sec.  15.6.  Private  business   switch   service   9-1-1
12    service.
13        (a)    After  June  30,  1996, an entity that installs or
14    operates a new private business switch service or replaces an
15    existing  private  business  switch  service   and   provides
16    telecommunications facilities or services to businesses shall
17    provide  to  those business end users the same level of 9-1-1
18    service as  the  public  agency  and  the  telecommunications
19    carrier  are  providing  to  other  business end users of the
20    local 9-1-1 system.  This service shall include, but  not  be
21    limited  to, the capability to identify the telephone number,

 1    extension number, and  the  physical  location  that  is  the
 2    source  of the call to the number designated as the emergency
 3    telephone  number.   After  June  30,  1999,   all   entities
 4    providing  or  operating  a  private  business switch service
 5    shall be in compliance with this Section.
 6        (b)  The private business switch operator is  responsible
 7    for  forwarding  end  user  automatic location identification
 8    record information to the 9-1-1 system provider according  to
 9    the  format,  frequency,  and  procedures established by that
10    system provider.
11        (c)  This  Act  does  not  apply  to  any  PBX  telephone
12    extension that uses radio transmissions to convey  electrical
13    signals  directly  between  the  telephone  extension and the
14    serving PBX.
15        (d)  An entity that violates this Section is guilty of  a
16    business  offense and shall be fined not less than $1,000 and
17    not more than $5,000.
18        (e)  Nothing  in  this  Section  shall  be  construed  to
19    preclude the Attorney General on behalf of the Commission  or
20    on  the  Attorney General's his or her own initiative, or any
21    other interested person, from  seeking  judicial  relief,  by
22    mandamus, injunction, or otherwise, to compel compliance with
23    this Section.
