 1                          HOUSE RESOLUTION

 2        WHEREAS, Illinois Department  of  Revenue  Director  Glen
 3    Bower   has   proposed   transferring   25  Revenue  criminal
 4    investigators  to  patrol  riverboats  used   for   riverboat
 5    gambling  and to replace those Revenue criminal investigators
 6    with auditors and computer operators; and

 7        WHEREAS, This transfer could compromise investigations of
 8    tax fraud and could result in the loss of millions of dollars
 9    to the State Treasury; and

10        WHEREAS, A reduction in the number  of  Revenue  criminal
11    investigators  could eliminate the fear of getting prosecuted
12    for cheating on taxes, which could encourage some  people  to
13    cheat on their taxes; and

14        WHEREAS,  A  reduction  in the number of Revenue criminal
15    investigators would make it impossible for the Department  of
16    Revenue  to  investigate the over 5,200,000 individual income
17    tax returns  and  hundreds  of  thousands  of  corporate  tax
18    returns  filed  with the Department of Revenue, the more than
19    243,000 taxpayers registered for sales tax, and the thousands
20    of taxpayers required to file tax returns  for  thousands  of
21    other State and local taxes; and

22        WHEREAS,  Excise tax evasion, particularly motor fuel tax
23    evasion, cannot be detected with an audit  and  can  only  be
24    detected through proven law enforcement techniques; and

25        WHEREAS,   Illinois'   proximity  to  states  with  lower
26    cigarette taxes makes cigarette smuggling very profitable for
27    tax cheats at the expense of Illinois taxpayers; and

28        WHEREAS, Auditors cannot address the issue  of  cigarette
29    smuggling; and

30        WHEREAS,  Internal  Revenue Service information indicates

 1    that for every $1.06 spent on  criminal  enforcement  of  tax
 2    laws  there  is  a  $200  return  from  voluntary compliance;
 3    therefore, be it

 4        RESOLVED,  BY  THE  HOUSE  OF   REPRESENTATIVE   OF   THE
 5    NINETY-FIRST  GENERAL  ASSEMBLY,  that  we  urge the Illinois
 6    Department  of  Revenue  to  refrain  from  transferring  any
 7    Revenue criminal investigators to patrol riverboats used  for
 8    riverboat  gambling  and  to  refrain  from  replacing  those
 9    Revenue  criminal  investigators with other personnel; and be
10    it further

11        RESOLVED, That suitable  copies  of  this  resolution  be
12    delivered  to  Glen  Bower  and  to  the Speaker and Minority
13    Leader of the House of Representatives and to  the  President
14    and Minority Leader of the Senate.
