 1                          HOUSE RESOLUTION

 2        WHEREAS, On July 20, 1999, the Governor signed  into  law
 3    Senate  Bill  1063  (Public  Act  91-212)  in  order to bring
 4    Illinois into compliance with the Personal Responsibility and
 5    Work Reconciliation Act of 1996 which mandated that the State
 6    of Illinois establish a State Disbursement Unit by October 1,
 7    1999; and

 8        WHEREAS, Senate Bill 1063 created the State  Disbursement
 9    Unit on October 1, 1999, centralizing the collection of child
10    support  payments  through one agency in DuPage County rather
11    than through 102 separate Circuit  Clerk  Offices  throughout
12    the State; and

13        WHEREAS,  The  Illinois  Department  of  Public  Aid  was
14    required to inform those who would be affected by the changes
15    in child support payments caused by Senate Bill 1063; and

16        WHEREAS,   In   the  month  of  October  1999  the  State
17    Disbursement  Unit,  under  the  direction  of  the  Illinois
18    Department of Public Aid, was unable to  issue  thousands  of
19    child   support   payments  due  to  insufficient  data  from
20    employers, lack of communication with numerous circuit  court
21    clerks,  and  seriously  underestimating the magnitude of the
22    problems we are now experiencing with the centralized system;
23    therefore, be it

24        RESOLVED,  BY  THE  HOUSE  OF  REPRESENTATIVES   OF   THE
25    NINETY-FIRST  GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
26    we urge  the  Illinois  Department  of  Public  Aid  and  the
27    Governor  of  the  State  of  Illinois to continue to provide
28    immediate relief for families whose  child  support  payments
29    have  been  been  deferred  and  delayed,  and to immediately
30    initiate and develop a plan with the federal government  that
31    will  enable  the  Department  to  take  steps  to reduce the
32    workload at the State Disbursement Unit to allow time for the

 1    Unit, in cooperation with employers and  Circuit  Clerks,  to
 2    correct  the  start-up  problems  that  are causing delays in
 3    payments to children and families; and be it further

 4        RESOLVED, That,  in  accordance  with  a  motion  of  the
 5    Illinois   Association   of  Circuit  Court  Clerks  (IACCC),
 6    approved and adopted October  22,  1999,  we  recommend  that
 7    policies  and  procedures  be  adopted  to  allow the Circuit
 8    Clerks  of  the  State  of  Illinois  to  resume  duties   of
 9    collection  and  disbursement of child support payments where
10    needed and to the  extent  necessary  to  ensure  timely  and
11    effective processing and distribution of such payments.
