1 HOUSE JOINT RESOLUTION
2 WHEREAS, In the year 2001, the Detection of Deception
3 Examiners Act, the statute which governs the licensing and
4 regulation of polygraph examiners, sunsets and must be
5 renewed; and
6 WHEREAS, This Act requires extensive minimum levels of
7 training and experience for licensure of detection of
8 deception examiners, as well as compliance with
9 administrative rules, enforced by the Department of
10 Professional Regulation; and
11 WHEREAS, The practice of detection of deception is
12 declared to affect the public health, safety, and welfare and
13 is subject to regulation and control in the public's
14 interest; and
15 WHEREAS, Illinois has long been recognized as a leader in
16 the field of deception detection, with the polygraph
17 providing an important investigative role in this state; and
18 WHEREAS, Developing and emerging electronic technology
19 may have produced additional methods by which to detect
20 deception, including computer voice stress analysis; and
21 WHEREAS, It is imperative for the State of Illinois to
22 not only address the sunset issue associated with the
23 Detection of Deception Examiners Act, but also to study and
24 re-examine current licensing criteria as well as to review
25 any new and emerging detection of deception methodologies;
26 therefore, be it
27 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
28 NINETY-FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
29 SENATE CONCURRING HEREIN, that the Department of Professional
30 Regulation is directed to conduct a study of the existing
31 detection of deception examiners licensing criteria regarding

1 all aspects of minimum criteria including, but not
2 necessarily limited to, training, education, experience, and
3 testing of applicants for detection of deception licenses;
4 and be it further
5 RESOLVED, That the study shall include the review and
6 analysis of new and emerging deception detection technology,
7 such as computer voice stress analysis; and be it further
8 RESOLVED, That the Department of Professional Regulation
9 shall conclude the study by December 1, 1999 and shall
10 forward the report of its findings and recommendations to the
11 Speaker of the House, the Minority Leader of the House, the
12 President of the Senate, the Minority Leader of the Senate,
13 and the Governor by December 31, 1999; and be it further
14 RESOLVED, That a suitable copy of this resolution be
15 presented to the Director of Professional Regulation.
