 1                       HOUSE JOINT RESOLUTION
 2                      CONSTITUTIONAL AMENDMENT

 3        RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE  NINETY-
 4    FIRST  GENERAL  ASSEMBLY OF THE STATE OF ILLINOIS, THE SENATE
 5    CONCURRING HEREIN, that  there  shall  be  submitted  to  the
 6    electors  of  the  State  for  adoption  or  rejection at the
 7    general election next occurring at least 6 months  after  the
 8    adoption  of  this  resolution a proposition to amend Article
 9    XIII of the Illinois Constitution  by  adding  Section  9  as
10    follows:

11                            ARTICLE XIII
12                         GENERAL PROVISIONS

13        (ILCON Art. XIII, Sec. 9 new)
14    SECTION 9.  MOTOR FUEL TAX REVENUE
15        (a)  Revenue from excise taxes imposed on motor fuel must
16    be  used  exclusively for the construction and maintenance of
17    State highways, for the payment of principal and interest  on
18    bonds  issued  for  the construction and maintenance of State
19    highways,  for  the  acquisition   of   real   property   and
20    rights-of-way    for   State   highways,   and   for   public
21    transportation.
22        (b)  The tax revenues  designated  for  the  purposes  in
23    subsection (a) may be loaned to another fund to be used for a
24    different purpose according to the following requirements:
25             (1)  That  any amount loaned is to be repaid in full
26        to the fund from which it was borrowed  during  the  same
27        fiscal  year  in  which  the  loan  was made, except that
28        repayment may be delayed until a date not  more  than  30
29        days  after the date of enactment of the State budget for
30        the subsequent fiscal year.
31             (2)  That any amount loaned is to be repaid in  full
32        to  the  fund  from which it was borrowed within 3 fiscal

 1        years from the date on which the loan  was  made  if  the
 2        Governor has proclaimed a state of emergency and declares
 3        that  the emergency will result in a significant negative
 4        fiscal impact to the State.
 5        (c)  Nothing  in  this  Section  prohibits  the   General
 6    Assembly  from  authorizing  by  law  loans to units of local
 7    government from funds that are subject to  this  Section  for
 8    the purposes authorized under this Section.

 9                              SCHEDULE

10        This Constitutional Amendment takes effect July 1, 2002.
