 1        AN ACT to amend the Consumer Fraud and Deceptive Business
 2    Practices Act by adding Section 2KK.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.  The  Consumer  Fraud  and Deceptive Business
 6    Practices Act is amended by adding Section 2KK as follows:

 7        (815 ILCS 505/2KK new)
 8        Sec. 2KK.  Billing practices for cellular phone service.
 9        (a)  As used in this Section:
10             (1)  "Cellular phone" means a device that  by  means
11        of  two-way  cellular, broadband PCS, geographic area 800
12        MHZ and 900 MHZ commercial mobile radio service, wireless
13        communications service, or other commercial mobile  radio
14        service,   as   defined  by  the  Federal  Communications
15        Commission, enables a  person  to  engage  in  real-time,
16        two-way  voice  communication  and is interconnected with
17        the public switched network.
18             (2)  "Wireless carrier" means a provider of  two-way
19        cellular,  broadband PCS, geographic area 800 MHZ and 900
20        MHZ Commercial  Mobile  Radio  Service  (CMRS),  Wireless
21        Communications  Service (WCS), or other Commercial Mobile
22        Radio  Service  (CMRS),  as  defined   by   the   Federal
23        Communications  Commission, offering radio communications
24        that  may  provide  fixed,  mobile,  radio  location,  or
25        satellite  communication  services  to   individuals   or
26        businesses   within   its  assigned  spectrum  block  and
27        geographical area or that offers real-time, two-way voice
28        service that is interconnected with the  public  switched
29        network, including a reseller of such service.
30        (b)  A  wireless  carrier  may  not  impose a charge on a
31    consumer for receiving a call by means of  a  cellular  phone

 1    that  has  a telephone number within an area code assigned to
 2    Illinois by the North American Numbering  Plan  Administrator
 3    unless  the  consumer  is  given  a reasonable opportunity to
 4    cancel receipt of the call after answering without  incurring
 5    a charge or any other obligation.
 6        (c)  Any  person  who  violates  this  Section commits an
 7    unlawful practice within the meaning of this Act.
