1 AN ACT to amend the Credit Card Issuance Act by adding
2 Section 1d.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Credit Card Issuance Act is amended by
6 adding Section 1d as follows:
7 (815 ILCS 140/1d new)
8 Sec. 1d. Civil liability of issuer. An issuer of a
9 credit card who offers immediate credit to a person at the
10 time of application for the credit card and who fails to
11 obtain from the applicant, before extending credit to the
12 applicant, adequate evidence of the identity of the applicant
13 and issues a credit card to the applicant under the name of
14 another person is liable for any damages resulting from the
15 issuance of that credit card including the payment of late
16 fees to other issuers of credit cards for nonpayment.
17 As used in this Section "adequate evidence of identity"
18 means the written proof of identity that the Secretary of
19 State requires in order to issue an Illinois drivers license
20 or an Illinois Identification Card.
