1 AN ACT to amend the Criminal Code of 1961 by changing
2 Section 11-20.2.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Criminal Code of 1961 is amended by
6 changing Section 11-20.2 as follows:
7 (720 ILCS 5/11-20.2) (from Ch. 38, par. 11-20.2)
8 Sec. 11-20.2. Report of child pornography to peace
9 officer.
10 (a) Any commercial film and photographic print processor
11 or any person who services or repairs computers who has
12 knowledge of or observes, within the scope of his or her
13 professional capacity or employment, any film, photograph,
14 videotape, negative or slide or any data stored in computer
15 memory in any format which depicts a child whom the
16 processor or person who services or repairs the computer
17 knows or reasonably should know to be under the age of 18
18 where such child is:
19 (i) actually or by simulation engaged in any act of
20 sexual intercourse with any person or animal; or
21 (ii) actually or by simulation engaged in any act
22 of sexual contact involving the sex organs of the child
23 and the mouth, anus, or sex organs of another person or
24 animal; or which involves the mouth, anus or sex organs
25 of the child and the sex organs of another person or
26 animal; or
27 (iii) actually or by simulation engaged in any act
28 of masturbation; or
29 (iv) actually or by simulation portrayed as being
30 the object of, or otherwise engaged in, any act of lewd
31 fondling, touching, or caressing involving another person

1 or animal; or
2 (v) actually or by simulation engaged in any act of
3 excretion or urination within a sexual context; or
4 (vi) actually or by simulation portrayed or
5 depicted as bound, fettered, or subject to sadistic,
6 masochistic, or sadomasochistic abuse in any sexual
7 context; shall report such instance to a peace officer
8 immediately or as soon as possible.
9 (b) Failure to make the report required by subsection
10 (a) is a petty such report shall be a business offense with a
11 fine of $1,000.
12 (c) For the purposes of this Section, "computer" and
13 "data" have the meanings ascribed to them in Section 16D-2 of
14 this Code.
