 1        AN ACT concerning historic preservation.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Illinois  Historic Preservation Act is
 5    amended by changing Section 6 as follows:

 6        (20 ILCS 3410/6) (from Ch. 127, par. 133d6)
 7        Sec. 6.  The  Agency  shall  establish  and  maintain  an
 8    Illinois  Register  of Historic Places.  To be listed on this
 9    register,   a   place   must   have    special    historical,
10    architectural,  archeological, cultural, or artistic interest
11    or value.  The Council shall develop and  make  available  to
12    the  public  guidelines reflecting the criteria for inclusion
13    within 90 days of  the  effective  date  of  this  Act.   The
14    criteria  shall  include, but not be limited to, requirements
15    that Registered Illinois Historic Places be limited to  those
16    places  that  possess integrity of location, design, setting,
17    materials, workmanship, feeling and association, and:
18        (1)  that are associated with  events  or  the  lives  of
19    persons  that  have  made  a  significant contribution to the
20    broad patterns of our history; or
21        (2)  that embody the  distinctive  characteristics  of  a
22    type, period or method of construction, or that represent the
23    work  of  a  master, or that possess high artistic values, or
24    that represent a significant and distinguishable entity whose
25    components may lack individual distinction; or
26        (3)  that exemplify elements of our  cultural,  economic,
27    social or historic heritage; or
28        (4)  that   have   yielded,   or  are  likely  to  yield,
29    information important in prehistory or history.
30        Places listed on the Illinois Register of Historic Places
31    shall be places designated by the Director  from  nominations

 1    made   by   the  Council.   The  Council  shall  provide  for
 2    consideration of places upon the petition of any person.  The
 3    Council may  nominate  any  place,  which  in  the  Council's
 4    opinion  is  within the criteria established pursuant to this
 5    Act.  Particular  consideration  shall  be  given  to  places
 6    listed from time to time in the National Register of Historic
 7    Places  or  the  Historic  American  Building  Survey, or any
 8    branch of the Illinois Historic Sites Survey,  or  designated
 9    by  a  municipal  preservation agency or municipal authority.
10    Particular consideration shall be  given  to  places  in  the
11    neighborhood of 87th and Emerald in the City of Chicago.
12        A  nomination order which includes a list of the Critical
13    Historic Features of the place and any amendments to such  an
14    order  shall  be sent to the owner or owners of record of the
15    place at least 30 days before a meeting  of  the  Council  to
16    consider  the  nomination.  The Council, during its scheduled
17    meeting, shall only consider the nomination orders of a place
18    whose owner  or  owners  of  record  have  responded  to  the
19    nomination  by  submitting to the Council a letter of written
20    consent  approving  the  designation  of  the  place   as   a
21    Registered  Illinois  Historic  Place. The owner or owners of
22    record shall have the  right  to  be  heard  and  to  present
23    evidence  at  such  meeting.   If such owner or owners do not
24    consent to the designation  of  the  place  as  a  Registered
25    Illinois  Historic  Place,  the Council shall take no further
26    action with respect to such place.  If such owner  or  owners
27    consent  to  the  designation  of  the  place as a Registered
28    Illinois Historic Place, the nomination order shall  be  made
29    publicly  available  for  review at least 30 days before such
30    designation.  Before any  nomination  order  is  approved  it
31    shall  be  considered  at a public meeting of the Council and
32    the public shall have reasonable opportunity to be heard.  On
33    the advice of the Council, the Director may amend designation
34    orders to reflect new information or changed conditions.  The

 1    designation order,  and  any  amendments  thereof,  shall  be
 2    submitted  by  the Agency for recording with the recorder for
 3    the county or counties in which the area is located.
