1 AN ACT to amend the Consumer Fraud and Deceptive Business
2 Practices Act by adding Section 2KK.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Consumer Fraud and Deceptive Business
6 Practices Act is amended by adding Section 2KK as follows:
7 (815 ILCS 505/2KK new)
8 Sec. 2KK. Cash refunds. Whenever a consumer who paid
9 cash for merchandise returns that merchandise to the seller
10 and the seller determines that the consumer is due a refund
11 for that merchandise, that refund must be in cash.
12 Refunds for returned merchandise purchased by credit card
13 or debit card must be by credit to those card accounts.
14 Refunds for returned merchandise purchased by personal
15 check must be by a check from the seller.
16 Refunds for returned merchandise purchased by a check
17 that is guaranteed by a bank or other credit issuer must be
18 in cash.
19 A seller that violates this Section commits an unlawful
20 practice under this Act.
21 Section 99. Effective date. This Act takes effect upon
22 becoming law.
