1 AN ACT to amend the Adoption Act.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Adoption Act is amended by changing
5 Section 12 as follows:
6 (750 ILCS 50/12) (from Ch. 40, par. 1514)
7 Sec. 12. Consent of child or adult. If, upon the date
8 of the entry of the judgment the person sought to be adopted
9 is of the age of 14 years or upwards, the adoption shall not
10 be made without the consent of that such person. The Such
11 consent shall be in writing and shall be acknowledged by a
12 such person as provided in Section 10 of this Act, provided,
13 that if that such person is in need of mental treatment or
14 mentally retarded, the court may waive the provisions of this
15 Section. No consent shall be required under this Section if
16 the person sought to be adopted has died before giving such
17 consent.
