 1                    AMENDMENT TO HOUSE BILL 3617

 2        AMENDMENT NO.     .  Amend House Bill 3617  by  replacing
 3    the title with the following:

 4        "AN ACT concerning local boards"; and

 5     by  replacing  everything after the enacting clause with the
 6    following:

 7        "Section 5.  The Counties Code  is  amended  by  changing
 8    Sections 2-3002.5 and 2-3006 as follows:

 9        (55 ILCS 5/2-3002.5)
10        Sec.  2-3002.5.  Beginning  with  members  elected at the
11    general election in 2002 January 2, 2001, counties  having  a
12    population  between  800,000  and 3,000,000 according to 2000
13    decennial census shall have no more than 18 members on  their
14    county  board. If the chairman of the county board is elected
15    at-large by the voters of the county as provided  in  Section
16    2-3007,  the chairman shall not be counted as a member of the
17    county board for the purpose of the limitations on  the  size
18    of  the  county  board  provided  in this Section.  Neither a
19    member nor the chairman of  that  county  board  shall  serve
20    simultaneously  as  commissioner or president of the board of
21    commissioners of the forest  preserve  district.   No  person

 1    shall  seek  election to both the county board and the forest
 2    preserve commission at the same election.

 5        Sec. 2-3006. Failure to file apportionment plan; election
 6    of board members at large. If no apportionment plan is  filed
 7    with  the  county  clerk  as  required  by this Division, the
 8    members of the county board shall be elected at large in  the
 9    county.  If  the  county  board  has determined the number of
10    members  for  the  board,  that  number  shall  be   elected;
11    otherwise,  the  number of members to be elected shall be the
12    largest number to which the county is entitled under Sections
13    2-3002 and 2-3002.5.

15        Section 10.  The Downstate Forest Preserve  District  Act
16    is amended by changing Sections 3c and 12 as follows:

17        (70 ILCS 805/3c)
18        Sec.  3c.  Elected  board  of  commissioners  in  certain
19    counties.  If  the  boundaries of a district are co-extensive
20    with the boundaries of a county having a population  of  more
21    than  800,000  but  less than 3,000,000, all commissioners of
22    the forest preserve district shall be elected from  the  same
23    districts  as  members of the county board beginning with the
24    general election held in 2002  and  each  succeeding  general
25    election.   One  commissioner  shall  be  elected  from  each
26    district.   At  their  first  meeting after their election in
27    2002 and following each subsequent decennial  reapportionment
28    of  the  county  under Division 2-3 of the Counties Code, the
29    elected commissioners shall publicly by lot divide themselves
30    into 3 2 groups, as equal in size as possible.  Commissioners
31    from the first group shall serve for terms of  2,  4,  and  4
32    years;  commissioners  from  the second group shall serve for

 1    terms of 4, 2, and 4 years and commissioners from the  second
 2    third  group  shall  serve  terms  of  4,  4,  and  2  years.
 3    Commissioners elected under this Section shall take office at
 4    the  first  meeting of commissioners following an election of
 5    commissioners.  Beginning with the general election in  2002,
 6    the  president  of  the  board of commissioners of the forest
 7    preserve district shall be  elected  by  the  voters  of  the
 8    county,  rather  than  by  the  commissioners.  The president
 9    shall be elected throughout the  county  for  a  4-year  term
10    without  having  been  first  elected  as commissioner of the
11    forest preserve district.  Neither  a  commissioner  nor  the
12    president  of  the  board  of  commissioners  of  that forest
13    preserve district shall serve  simultaneously  as  member  or
14    chairman  of the county board.  No person shall seek election
15    to both the forest preserve commission and the  county  board
16    at  the  same  election.   At that meeting, the commissioners
17    shall elect from among their number a president of the forest
18    preserve district board of commissioners to serve for a  term
19    of  2  years.   The  board  of  commissioners  shall  set The
20    compensation for the president shall be an  amount  equal  to
21    85%  of  the annual salary of the county board chairman.  The
22    president, with the  advice  and  consent  of  the  board  of
23    commissioners  shall appoint a secretary, treasurer, and such
24    other  officers  as  deemed  necessary  by   the   board   of
25    commissioners,  which  officers  need  not  be members of the
26    board of commissioners.  The president shall have the  powers
27    and duties as specified in Section 12 of this Act. Actions by
28    the board shall require a majority vote of the commissioners.
29        Candidates   for  commissioner  shall  be  candidates  of
30    established political parties.
31        If a vacancy in the office of commissioner occurs,  other
32    than by expiration of a commissioner's term, the president of
33    the board of commissioners shall, with the advice and consent
34    of other commissioners then serving, appoint an individual to

 1    serve for the remainder of the unexpired term.  The appointee
 2    shall  be  affiliated  with  the  same political party as the
 3    commissioner in whose office the vacancy occurred  and  be  a
 4    resident  of  such  district.   If a vacancy in the office of
 5    president occurs, other than by expiration of the president's
 6    term, the remaining members of  the  board  of  commissioners
 7    shall  appoint one of the commissioners to serve as president
 8    for the remainder of the unexpired term.  If,  however,  more
 9    than 28 months remain in the unexpired term of a commissioner
10    or  the  president,  the  appointment shall be until the next
11    consolidated election, at which time the  vacated  office  of
12    commissioner or president shall be filled by election for the
13    remainder of the term.
14        The   president  and  commissioners  elected  under  this
15    Section may  be  reimbursed  for  their  reasonable  expenses
16    actually  incurred  in performing their official duties under
17    this Act in accordance with the  provisions  of  Section  3a.
18    The  reimbursement  paid  under this Section shall be paid by
19    the forest preserve district.
20        Compensation for forest  preserve  commissioners  elected
21    under  this Section shall be the same as that of county board
22    members  of  the  county  with  which  the  forest   preserve
23    district's boundaries are co-extensive.

26        Sec.  12.   The  president  of  the board of any district
27    organized hereunder, shall preside at  all  meetings  of  the
28    board, and be the executive officer of the district, and be a
29    member   of   the   board.  He  shall  sign  all  ordinances,
30    resolutions and other papers necessary to be signed and shall
31    execute all  contracts  entered  into  by  the  district  and
32    perform  other  duties  as may be prescribed by ordinance. He
33    may veto  any  ordinance  and  any  orders,  resolutions  and

 1    actions,  or  any items therein contained, of the board which
 2    provide  for  the  purchase  of  real  estate,  or  for   the
 3    construction  of  improvements  within  the  preserves of the
 4    district. Such veto shall be filed with the secretary of  the
 5    board  within  5  days  after  the  passage of the ordinance,
 6    order, resolution or action and when so vetoed the ordinance,
 7    order, resolution or action or any item therein contained  is
 8    not effective unless it is again passed by two-thirds vote of
 9    all  the  members of the board. The president may vote in the
10    same manner as  the  other  members  of  the  board.  In  the
11    temporary  absence or inability of the president, the members
12    of the board may elect from their own number a president, pro
13    tem.
14        The "Yeas" and "Nays" shall be taken, and entered on  the
15    journal  of  the board's proceedings, upon the passage of all
16    ordinances and all proposals to create any liability, or  for
17    the expenditure or appropriation of money. The concurrence of
18    a  majority  of  all  the members elected or appointed to the
19    board is necessary to the passage of any  such  ordinance  or
20    proposal.  In  all other cases the "Yeas" and "Nays" shall be
21    taken at the request of any member of the board and shall  be
22    entered on the journal of the board's proceedings."

24        Section  99.  Effective date.  This Act takes effect upon
25    becoming law.".
