 1        AN  ACT  to amend the Children's Health Insurance Program
 2    Act by changing Section 35.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The Children's Health Insurance Program Act
 6    is amended by changing Section 35 as follows:

 7        (215 ILCS 106/35)
 8        (Section scheduled to be repealed on June 30, 2001)
 9        Sec. 35.  Funding for the Program.
10        (a)  This Program is not an entitlement and shall not  be
11    construed  to  create  an  entitlement.   Eligibility for the
12    Program is subject to appropriation of funds by the State and
13    federal governments.  Subdivision (a)(2) of Section 25  shall
14    operate  and  be funded only if subdivision (a)(1) of Section
15    25 is operational and funded.  The estimated net State  share
16    of  appropriated  funds  for subdivision (a)(2) of Section 25
17    shall  be  equal  to  the  estimated  net  State   share   of
18    appropriated funds for subdivision (a)(1) of Section 25.
19        (b)  Any  requirement  imposed  under  this  Act  and any
20    implementation of this Act by the Department shall  cease  in
21    the   event  (1)  continued  receipt  of  federal  funds  for
22    implementation of this Act requires an amendment to this Act,
23    or (2) federal funds for implementation of the  Act  are  not
24    otherwise available.
25        (c)  Payments  under  this Act shall be appropriated from
26    the General Revenue Fund and other funds that are  authorized
27    to  be  used to reimburse or make medical payments for health
28    care benefits under this Act  or  Title  XXI  of  the  Social
29    Security Act.
30        (d)  Benefits  under  this Act shall be available only as
31    long as the intergovernmental  agreements  made  pursuant  to

 1    Section 12-4.7 and Article XV of the Illinois Public Aid Code
 2    and  entered  into between the Department and the Cook County
 3    Board of Commissioners continue to exist.
