 1        AN ACT concerning mobile home parks.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Mobile  Home  Park  Act  is  amended by
 5    changing Section 6 as follows:

 6        (210 ILCS 115/6) (from Ch. 111 1/2, par. 716)
 7        Sec. 6. In addition to the application fees provided  for
 8    herein, the licensee shall pay to the Department on or before
 9    March  31  of each year, an annual license fee which shall be
10    $100 plus $5 $3 for each  mobile  home  space  in  the  park.
11    Annual license fees submitted after April 30 shall be subject
12    to  a  $50  late  fee.   The licensee shall also complete and
13    return a license renewal application  by  March  31  of  each
14    year.
15        The  licensee  shall pay to the Department within 30 days
16    of receipt of notification from the Department $5 $6 for each
17    additional mobile home site added to his park under authority
18    of a written permit to alter the park as provided in  Section
19    4.2 of this Act, payment for the additional mobile home sites
20    to  be  made  and an amended license therefor obtained before
21    any mobile homes are accommodated on  the  additional  mobile
22    home spaces. The Department shall issue an amended license to
23    cover  such additional mobile home sites, when they are to be
24    occupied before the end of the license  year,  for  which  an
25    annual license has been previously issued.
26        Subsequent   to  the  effective  date  of  this  Act,  an
27    applicant for an original  license  to  operate  a  new  park
28    constructed  under  a  permit  issued by the Department shall
29    only be required to pay 1/4 of the annual fee  if  such  park
30    begins operation after the 31st day of January and before the
31    1st  day  of May of such licensing year; or 1/2 of the annual

 1    fee if such park begins  operation  after  the  31st  day  of
 2    October  and before the 1st day of February of such licensing
 3    year or 3/4 of the annual fee if such park  begins  operation
 4    after the 31st day of July and before the 1st day of November
 5    of  such  licensing  year;  but  shall be required to pay the
 6    entire annual fee if such park  begins  operation  after  the
 7    30th  day  of  April and before the 1st day of August of such
 8    licensing year.
 9        Each license fee shall be paid to the Department and  any
10    license fee or any part thereof, once paid to and accepted by
11    the Department shall not be refunded.
12        The  Department  shall  deposit  all funds received under
13    this Act in the Facility Licensing Fund State Treasury.

15        Section 10.  The Mobile Home Landlord and  Tenant  Rights
16    Act is amended by adding Sections 27 and 28 as follows:

17        (765 ILCS 745/27 new)
18        Sec. 27. Mobile Home Park Ombudsman.
19        (a)  The office of Mobile Home Park Ombudsman is created.
20    The  Ombudsman  shall  be appointed by the Director of Public
21    Health and shall be an employee of the Department of   Public
22    Health.
23        (b)  The  Ombudsman  shall serve as a liaison between the
24    State, mobile home park owners, and tenants of  mobile  homes
25    and  shall  protect  the  rights and interests of mobile home
26    tenants and mobile home  park  owners.  The  Ombudsman  shall
27    receive  and  investigate  complaints related to this Act for
28    the purpose of obtaining non-binding resolution of  conflicts
29    between  park  owners  and  tenants  related to this Act. The
30    Ombudsman may  seek  the  advice  of  individuals  possessing
31    specific  expertise or members of the Mobile Home Park Owners
32    and Tenants Advisory Board.

 1        (c)  The Ombudsman shall refer violations of this Act  to
 2    the Attorney General for enforcement activity.

 3        (765 ILCS 745/28 new)
 4        Sec.  28.  Mobile  Home  Park Owners and Tenants Advisory
 5    Board.
 6        (a)  The Mobile Home Park  Owners  and  Tenants  Advisory
 7    Board is created to consult with and advise the Department of
 8    Public  Health.  The  Board  shall be comprised of the Mobile
 9    Home Park Ombudsman who shall serve as  Chairman  ex  officio
10    and  10  members as follows: 2 residents of mobile home parks
11    who have lived in mobile homes for  at  least  5  years;  the
12    president of a state association of mobile home owners or his
13    or  her representative; 3 individuals who have owned a mobile
14    home park of at least 20  sites  for  at  least  5  years;  a
15    representative  of  the  Cook  County  Department  of  Public
16    Health; a building official familiar with the installation of
17    mobile homes; a representative of the American Association of
18    Retired People; and a representative of the Statewide Housing
19    Action Coalition.
20        (b)  Members  of  the  Board  shall  be  appointed by the
21    Ombudsman for 3 year  terms,  except  that,  of  the  initial
22    members,  3 members shall serve through December 31, 2002 and
23    3 members shall serve  through  December  31,  2003.  Members
24    shall   serve   until  their  successors  are  appointed  and
25    qualified.  Any member appointed to fill a vacancy  occurring
26    before  the  expiration  of  the  term  for  which his or her
27    predecessor  was  appointed  shall  be  appointed   for   the
28    remainder  of  that  term.  The  initial  appointments  shall
29    commence January 1, 2001.
30        (c)  The  Board  shall  meet  at least 3 times each year.
31    Additional meetings may be called by 3 members of  the  Board
32    upon  delivery  of  a  written  notice  to  the  Ombudsman. A
33    majority of the members  of  the  Board  shall  constitute  a

 1    quorum.  Each  member  of  the Board shall be compensated for
 2    travel expenses incurred in the performance of  duties  as  a
 3    member  of  the  Board  in  accordance  with the Rules of the
 4    Travel Regulation  Council  in  the  Illinois  Administrative
 5    Code.

 6        Section  99.  Effective date.  This Act takes effect upon
 7    becoming law.
