 1        AN ACT concerning the levy of taxes by school boards.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 3.  The Property Tax Code is  amended  by  adding
 5    Section 18-72 as follows:

 6        (35 ILCS 200/18-72 new)
 7        Sec.  18-72.  A  school board shall give public notice of
 8    and  hold  a  public  hearing  on  its  intent  to  amend   a
 9    certificate  of  tax levy under Section 17-11.1 of the School
10    Code.

11        Section 5.   The  School  Code  is  amended  by  changing
12    Section 17-11.1 as follows:

13        (105 ILCS 5/17-11.1) (from Ch. 122, par. 17-11.1)
14        Sec.  17-11.1.   Amended  Tax Certificate.  When a school
15    board has authority to levy taxes at the  maximum  permissive
16    tax  rate  allowed  by law or the maximum tax rate allowed by
17    voter approved referendum an operating tax rate  which  would
18    qualify  the  school district for the maximum amount of State
19    aid under Section 18-8 and, after the certificate of tax levy
20    has been filed, a change in the assessed valuation  resulting
21    from  the  application  of the equalization multiplier by the
22    Department  of  Revenue  causes  the  school  district's  tax
23    extensions to be less than the maximum  permissive  tax  rate
24    allowed  by  law  or  the  maximum  tax rate allowed by voter
25    approved referendum operating tax rate to be less  than  that
26    required  to qualify for the maximum amount of State aid, the
27    school board may, within 20 days of such  change,  amend  the
28    certificate  of tax levy to provide for the maximum amount of
29    tax extensions provided by the permissive tax rate or by  the

 1    voter  approved  referendum,  as  limited by the Property Tax
 2    Extension Limitation Law the amount required to  qualify  for
 3    the maximum amount of State aid.

 5        Section  99.  Effective date.  This Act takes effect upon
 6    becoming law.
