1 AN ACT to amend the Illinois Insurance Code by adding
2 Section 352b.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Insurance Code is amended by
6 adding Section 352b as follows:
7 (215 ILCS 5/352b new)
8 Sec. 352b. Premium increase limits. An insurer may not
9 increase the premium charges for a constant level of coverage
10 under a policy of accident and health insurance amended,
11 delivered, issued, or renewed in this State after the
12 effective date of this amendatory Act of the 91st General
13 Assembly by an amount that exceeds the percentage increase in
14 the Consumer Price Index for Medical Care, published by the
15 Bureau of Labor Statistics of the United States Department of
16 Labor, during the period beginning on the effective date of
17 the premium in effect at the time the increase is proposed
18 and ending on the effective date of the proposed premium
19 increase. This limitation applies separately to all types of
20 coverage provided under the policy. If an insurer increases
21 or decreases a level of coverage, this Section applies
22 proportionately to the coverage under the policy.
