1 AN ACT to amend the Illinois Wine and Spirits Industry
2 Fair Dealing Act of 1999 by changing Section 25.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Wine and Spirits Industry Fair
6 Dealing Act of 1999 is amended by changing Section 25 as
7 follows:

9 Sec. 25. Action for damages and injunctive relief.
10 Parties to a distributorship may bring an action in any court
11 of competent jurisdiction for damages sustained as a
12 consequence of the violation, and may also be granted
13 injunctive relief against unlawful termination, cancellation,
14 nonrenewal, or other harm. For agreements entered into or
15 renewed after May 21, 1999 the effective date of this Act,
16 this remedy is an addition to the remedies provided in
17 Section 35. It is the policy of this State to avoid unfair
18 or wrongful terminations. Notwithstanding any provisions of
19 any agreement between a supplier and a distributor, the venue
20 for any such action shall be at the location of the
21 distributorship and this Act shall apply.
