1 AN ACT to amend the Local Governmental and Governmental
2 Employees Tort Immunity Act by adding Section 4-108.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Local Governmental and Governmental
6 Employees Tort Immunity Act is amended by adding Section
7 4-108 as follows:
8 (745 ILCS 10/4-108 new)
9 Sec. 4-108. Weapons storage.
10 (a) Neither a local public entity nor a public employee
11 is liable for any injury resulting from the storage of or
12 failure to store any weapon, whether in the workplace or any
13 other place, unless the local public entity or public
14 employee is guilty of willful and wanton conduct with regard
15 to the storage of or failure to store the weapon.
16 (b) Neither a local public entity nor a public employee
17 is liable for any injury resulting from the failure to
18 provide weapons storage facilities or from the failure to
19 adopt adequate weapons storage procedures or regulations.
20 Section 99. Effective date. This Act takes effect upon
21 becoming law.
