 1        AN ACT in relation to environmental safety.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The Environmental Protection Act is amended
 5    by changing Section 22.35 as follows:

 6        (415 ILCS 5/22.35)
 7        Sec.  22.35.   Mixed  municipal  waste  compost   quality
 8    standards; end-product compost.
 9        (a)  By  January  1,  1994,  the Agency shall develop and
10    make recommendations to the Board concerning (i)  performance
11    standards  for  mixed  municipal waste compost facilities and
12    (ii) testing procedures and  standards  for  the  end-product
13    compost produced by mixed municipal waste compost facilities.
14        The  Agency,  in  cooperation  with the Department, shall
15    appoint a Technical Advisory Committee  for  the  purpose  of
16    developing  these  recommendations.   Among other things, the
17    Committee   shall   evaluate   environmental    and    safety
18    considerations,  compliance costs, and regulations adopted in
19    other  states  and  countries.   The  Committee  shall   have
20    balanced    representation    and   shall   include   members
21    representing   academia,   the   composting   industry,   the
22    Department  of   Agriculture,   the   landscaping   industry,
23    environmental organizations, municipalities, and counties.
24        Performance  standards  for mixed municipal waste compost
25    facilities shall at a minimum include:
26             (1)  the management of vectors, potential  exposures
27        for human disease, litter, and odor;
28             (2)  the management of surface water and leachate;
29             (3)  provisions   restricting   the   processing  of
30        potential contaminants and  problem  materials,  such  as
31        heavy metals.

 1             (4)  contingency planning for handling residuals and
 2        end-product   compost   material   that   does  not  meet
 3        requirements of subsection (b);
 4             (5)  plans for intended purpose of end-use  product;
 5        and
 6             (6)  a financial assurance plan necessary to restore
 7        the site as specified in Agency permit.
 8        (b)  By December 1, 1997, the Board shall adopt:
 9             (1)  performance standards for mixed municipal waste
10        compost facilities; and
11             (2)  testing   procedures   and  standards  for  the
12        end-product compost produced  by  mixed  municipal  waste
13        compost facilities.
14        The   Board   shall  evaluate  the  merits  of  different
15    standards for end-product compost applications.
16        (c)  Subsection (b)(2) shall  not  apply  to  end-product
17    compost  used  as  daily cover or vegetative amendment in the
18    final  layer.  Subsection  (b)  applies  to  any  end-product
19    compost offered for sale or use in Illinois.
20        (d)  For the purpose of this  Section,  "mixed  municipal
21    waste"  means  municipal  waste  generated  by households and
22    commercial  businesses  that  has  not  been  separated   for
23    composting at the point of generation.
