 1        AN ACT to amend the Code of Criminal Procedure of 1963 by
 2    adding Section 119-10.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.  The  Code  of  Criminal Procedure of 1963 is
 6    amended by adding Section 119-10 as follows:

 7        (725 ILCS 5/119-10 new)
 8        Sec. 119-10.  Commission on the death penalty;  delay  of
 9    executions.
10        (a)  No  execution  of  a defendant may take place for 18
11    months from the effective date of this amendatory Act of  the
12    91st  General Assembly.  A commission on the death penalty is
13    created to study the law that provides for the death  penalty
14    and  the administration of the death penalty.  The commission
15    must report to the General Assembly within 15 months from the
16    effective date of this amendatory Act  of  the  91st  General
17    Assembly.
18        (b)  The  commission consists of 8 members as follows:  2
19    members appointed by the Governor, 2 members appointed by the
20    Supreme Court, one member appointed by  the  Speaker  of  the
21    House   of  Representatives,  one  member  appointed  by  the
22    Minority Leader of the House of Representatives,  one  member
23    appointed  by  the  President  of  the Senate, and one member
24    appointed by the Minority Leader of the Senate.

25        Section 99.  Effective date.  This Act takes effect  upon
26    becoming law.
