 1                    AMENDMENT TO HOUSE BILL 2920

 2        AMENDMENT NO.     .  Amend House Bill 2920,  AS  AMENDED,
 3    in  Section 5, Sec. 10-26, by replacing all of subsection (e)
 4    with the following:

 5        "(e) This subsection applies to support payments received
 6    by the State Disbursement Unit on or after  October  1,  1999
 7    and applies only to support payments required to be processed
 8    by the State Disbursement Unit as provided in this Section.
 9        If  the  State  Disbursement  Unit  fails  to  disburse a
10    support payment to the person entitled to the payment  within
11    the  time  frame  prescribed by federal guidelines, then that
12    person is entitled to a civil penalty payment in addition  to
13    the support payment.  The civil penalty payment shall be paid
14    from  moneys  allocated  by  the  Illinois Department for the
15    operation of the State Disbursement Unit under the  agreement
16    described in subsection (a).  The amount of the civil penalty
17    payment  shall be 2% of the amount of the support payment for
18    each 30-day period or fraction of  such  a  period  that  the
19    support  payment  was  not  disbursed  within  the time frame
20    prescribed by federal guidelines.  A person is entitled to  a
21    civil  penalty payment under this subsection for each support
22    payment that was not disbursed to the person within the  time
23    frame prescribed by federal guidelines.

 1        A  person  entitled to a civil penalty payment under this
 2    subsection must apply to the State Disbursement Unit for  the
 3    payment.  The State Disbursement Unit shall determine whether
 4    an applicant for a civil penalty payment is eligible for  the
 5    payment  based  solely on whether the State Disbursement Unit
 6    failed to disburse a support payment to the applicant  within
 7    the  time  frame  prescribed  by  federal guidelines.  If the
 8    State Disbursement Unit determines that an  applicant  for  a
 9    civil  penalty payment is eligible for the payment, the State
10    Disbursement  Unit  shall  determine  the   amount   of   the
11    payment.".
