 1                    AMENDMENT TO HOUSE BILL 2882

 2        AMENDMENT NO.     .  Amend House Bill 2882 as follows:

 3    by replacing everything after the enacting  clause  with  the
 4    following:

 5        "Section  5.   The  Illinois  Vehicle  Code is amended by
 6    changing Sections 3-405.1 and 3-806.1 as follows:

 7        (625 ILCS 5/3-405.1) (from Ch. 95 1/2, par. 3-405.1)
 8        Sec. 3-405.1.  Application for  vanity  and  personalized
 9    license plates.
10        (a)  Vanity  license  plates  mean  any  license  plates,
11    assigned  to a passenger motor vehicle of the first division,
12    to a motor vehicle of the second division registered  at  not
13    more  than  8,000  pounds,  to  a trailer registered at 3,000
14    pounds or less, or to a recreational vehicle, which display a
15    registration number containing 4 to 7 letters as requested by
16    the owner of the vehicle and license plates issued to retired
17    members of Congress  under  Section  3-610.1  or  to  retired
18    members  of  the  General  Assembly  as  provided  in Section
19    3-606.1. A license plate  consisting  of  3  letters  and  no
20    numbers or of 1, 2 or 3 numbers, upon its becoming available,
21    is  a  vanity license plate. Personalized license plates mean

 1    any license plates, assigned to a passenger motor vehicle  of
 2    the  first  division,  to  a  motor  vehicle  of  the  second
 3    division, to a trailer registered at 3,000 pounds or less, or
 4    to  a  recreational  vehicle,  which  display  a registration
 5    number containing a combination of  letters  and  numbers  as
 6    prescribed by rule, as requested by the owner of the vehicle.
 7        (b)  For  any  registration period commencing after 1979,
 8    any person who is the registered owner of a  passenger  motor
 9    vehicle  of  the  first  division,  of a motor vehicle of the
10    second division registered at not more than 8,000 pounds,  of
11    a  trailer  registered  at  3,000  pounds  or  less,  or of a
12    recreational vehicle registered with the Secretary  of  State
13    or who makes application for an original registration of such
14    a  motor  vehicle  or  renewal  registration  of such a motor
15    vehicle may, upon payment of  a  fee  prescribed  in  Section
16    3-806.1,  apply  to  the  Secretary of State for personalized
17    license plates.
18        (c)  Except  for  plates  issued  under  Sections  3-627,
19    3-631, and 3-632, vanity and personalized license  plates  as
20    issued  under this Section shall be the same color and design
21    as other passenger vehicle license plates and  shall  not  in
22    any  manner  conflict  with  any  other  existing  passenger,
23    commercial,  trailer,  motorcycle,  or  special license plate
24    series.  However, special registration  plates  issued  under
25    Sections  3-611  and  3-616  for  vehicles operated by or for
26    persons with disabilities may also be vanity or  personalized
27    license plates.
28        (d)  Vanity  and  personalized  license  plates  shall be
29    issued only to the registered owner of the vehicle  on  which
30    they  are  to  be  displayed,  except as provided in Sections
31    3-611 and 3-616 for special registration plates for  vehicles
32    operated by or for persons with disabilities.
33        (e)  An   applicant   for   the  issuance  of  vanity  or
34    personalized license plates  or  subsequent  renewal  thereof

 1    shall file an application in such form and manner and by such
 2    date  as  the  Secretary  of  State  may,  in his discretion,
 3    require.
 4        No  vanity  nor  personalized  license  plates  shall  be
 5    approved,  manufactured,  or  distributed  that  contain  any
 6    characters,   symbols   other    than    the    international
 7    accessibility  symbol for vehicles operated by or for persons
 8    with disabilities, foreign words, or letters of punctuation.
 9        (f)  Vanity and personalized  license  plates  as  issued
10    pursuant  to  this  Act  may  be  subject  to  the  Staggered
11    Registration System as prescribed by the Secretary of State.

15        Sec. 3-806.1.  Additional fees for vanity license plates.
16    In addition to the regular  registration  fee,  an  applicant
17    shall  be  charged  $94 for each set of vanity license plates
18    issued to a motor vehicle of the first division  or  a  motor
19    vehicle  of  the  second division registered at not more than
20    8,000 pounds or to a trailer registered at  3,000  pounds  or
21    less  or  to  a  recreational vehicle and $50 for each set of
22    vanity plates issued to a motorcycle.   In  addition  to  the
23    regular  renewal  fee,  an applicant shall be charged $13 for
24    the renewal of each set of vanity license plates.

26        Section 99.  Effective date.  This Act takes effect  July
27    1, 2004.".
