 1        AN ACT in relation to the transfer of real property.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The Director of Natural Resources, on behalf
 5    of the State  of  Illinois,  is  authorized  to  execute  and
 6    deliver  to  The  Cedar  Grove  Church,  of  the  Village  of
 7    Buncombe,  County  of  Johnson, State of Illinois, for and in
 8    consideration of  $50  paid  to  the  Department  of  Natural
 9    Resources,  a Quit Claim Deed to the following described real
10    property:
11        The South 70.00 feet  of  the  West  50.00  feet  of  the
12        Southwest Quarter of the Northeast Quarter of Section 31,
13        Township  11  South,  Range 2 East of the Third Principal
14        Meridian, Johnson County,  Illinois,  as  said  Southwest
15        Quarter  of  the Northeast Quarter was surveyed by Edward
16        J.  Reeder,  I.P.L.S.  No.  2546  during  the  months  of
17        February through May of 1997.

18        Section 10. The Director of Natural Resources, on  behalf
19    of  the  State of Illinois, is authorized to exchange certain
20    real property in Cass County, Illinois, hereinafter  referred
21    to  as  Parcel 1, for certain real property of equal value in
22    Cass County, Illinois, hereinafter referred to as  Parcel  2,
23    such Parcels being described as follows:

24        PARCEL 1
25        A  part of the Southwest Quarter of the Northwest Quarter
26        of  Section  2,  lying  Northerly  and  Westerly  of  the
27        right-of-way of the proposed relocation of Gridley  Road,
28        containing  1.5 acres, more or less, and that part of the
29        Northeast Quarter of the Southeast Quarter of Section  3,
30        lying   within  the  fenced  boundary  of  Garner  Chapel
31        Cemetery, all in Township 17 North, Range 9 West  of  the

 1        Third  Principal Meridian, a more accurate description to
 2        be made by Survey.

 3        PARCEL 2
 4        One (1) acre in the Northwest  corner  of  the  Northwest
 5        Quarter of the Southwest Quarter of Section 2, heretofore
 6        conveyed  to  the  Trustees  of Garner Chapel by Warranty
 7        Deed dated February 13, 1889 and recorded March 21,  1890
 8        in  Volume 52 of Deeds at page 119, in Township 17 North,
 9        Range 9 West of the Third Principal Meridian.

10        Section 11. Whereas, the transaction described in Section
11    10 will be to the mutual advantages  of  both  parties,  each
12    party  shall  be  responsible  for  any  and  all title costs
13    associated with their respective properties.

14        Section 12.  The  Director  of  Natural  Resources  shall
15    obtain an opinion of title from the Illinois Attorney General
16    certifying   that   the   State   of  Illinois  will  receive
17    merchantable title to the real property referred to as Parcel
18    2 in Section 10.

19        Section 15. The Director of Natural Resources, on  behalf
20    of  the  State of Illinois, is authorized to exchange certain
21    real  property  in  McHenry  County,  Illinois,   hereinafter
22    referred  to  as Parcel 1, for certain real property of equal
23    or greater value in  McHenry  County,  Illinois,  hereinafter
24    referred  to  as  Parcel  2,  such Parcels being described as
25    follows:

26        PARCEL 1
27        9.56 acres, more or less, off of the  North  end  of  the
28        following described tract: The West Half of the Southeast
29        Quarter  of  Section  5;  (EXCEPTING  that  part  thereof
30        conveyed by Warranty Deed from Walter L. Krepel and Agnes

 1        M.  Krepel,  his  wife,  to Alfred F. Krepel, a bachelor,
 2        dated April  2,  1958  and  recorded  April  7,  1958  as
 3        Document  No.  336612, described as follows: That part of
 4        the Northwest Quarter of the Southeast  Quarter  of  said
 5        Section   5,  described  as  follows:  Beginning  at  the
 6        Northeast corner of the said  Northwest  Quarter  of  the
 7        said  Southeast  Quarter;  thence  West on the North line
 8        thereof, 387.20 feet; thence South parallel to  the  East
 9        line  thereof, 450 feet; thence East parallel to the said
10        North line, 387.20 feet to a point in the said East  line
11        thereof; thence North on said East line, 450 feet, to the
12        place  of  beginning), in Township 44 North, Range 9 East
13        of the  Third  Principal  Meridian,  in  McHenry  County,
14        Illinois, a more detailed legal description to be made by
15        an  accurate Land Survey, the cost thereof to be payed by
16        the owner of Parcel 2.

17        PARCEL 2
18        The Northeast Quarter of the Southeast Quarter of Section
19        S, EXCEPT the West 230 feet of the  North  550  feet  and
20        ALSO EXCEPT the West 320.00 feet of the North 396.12 feet
21        of said Section 5, all in Township 44 North, Range 9 East
22        of the Third Principal Meridian.

23        ALSO,
24        The  West 230 feet of the North 550 feet of the Northeast
25        Quarter of the Southeast Quarter of Section 5,  EXCEPTING
26        any  part  falling  in  the following described land: The
27        West 320.00 feet of the North 396.12 feet of said Section
28        5, all in Township 44 North, Range 9 East  of  the  Third
29        Principal Meridian.
30        All situated in McHenry County, Illinois.

31        Section 16. Whereas, the transaction described in Section
32    15  will  be  to  the mutual advantages of both parties, each

 1    party shall be  responsible  for  any  and  all  title  costs
 2    associated with their respective properties.

 3        Section  17.  The conveyance of Parcel 1 as authorized by
 4    Section 15 shall be made  subject  to:  (1)  existing  public
 5    utilities,   existing   public   roads   and   any   and  all
 6    reservations,   easements,   encumbrances,   covenants    and
 7    restrictions   of  record;  (2)  a  perpetual,  nonexclusive,
 8    unobstructed easement,  40  feet  in  uniform  width,  to  be
 9    reserved  by  the  State  of  Illinois, Department of Natural
10    Resources, for ingress and egress to and from adjoining  land
11    retained, owned or hereafter acquired by said Department, on,
12    over  and  across Parcel 1, a more detailed legal description
13    to be made by an accurate Land Survey, the cost thereof to be
14    payed by the owner of Parcel 2; and (3) the express condition
15    that if said real property  ceases  to  be  used  for  public
16    purposes it shall revert to the State of Illinois, Department
17    of Natural Resources.

18        Section  18.  The  Director  of the Department of Natural
19    Resources shall obtain an opinion of title from the  Illinois
20    Attorney  General  certifying that the State of Illinois will
21    receive merchantable title to the real property  referred  to
22    as Parcel 2 in Section 15.

23        Section  20. The Director of Natural Resources, on behalf
24    of the State  of  Illinois,  is  authorized  to  execute  and
25    deliver   to  the  appropriate  public  road  authorities  or
26    districts of the County of Cass, State of Illinois,  for  and
27    in  consideration  of  $1  paid  to the Department of Natural
28    Resources and other good and valuable consideration, a  grant
29    of  right-of-way  for  public  road purposes, subject to such
30    conditions as may be determined by the Department, on,  over,
31    and across the following described real property:

 1        Lands  owned  by  the  People  of  the State of Illinois,
 2        managed  and  operated  by  the  Department  of   Natural
 3        Resources, comprising what is commonly known as Site "M",
 4        and  being situated in Township 17 North, Range 9 West of
 5        the Third Principal Meridian, Township 17 North, Range  8
 6        West  of the Third Principal Meridian, Township 18 North,
 7        Range 9 West of the Third Principal Meridian, Township 18
 8        North, Range 8 West of the Third Principal Meridian,  and
 9        Township  19  North,  Range 9 West of the Third Principal
10        Meridian, Cass County, Illinois.

11        Section 25.  The  Director  of  Natural  Resources  shall
12    obtain   a  certified  copy  of  the  portions  of  this  Act
13    containing the title,  the  enacting  clause,  the  effective
14    date,   the   appropriate   Sections   containing   the  land
15    descriptions of property to be transferred, and this  Section
16    within  60  days  after  this  Act's effective date and, upon
17    receipt of payment  required  by  the  appropriate  Sections,
18    shall  record the certified document in the Recorder's office
19    in the county in which the land is located.

20        Section 99. Effective date. This Act  takes  effect  upon
21    becoming law.
