 1        AN ACT to amend the School Code by adding Section 27-8.2.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The School Code is amended by adding  Section
 5    27-8.2 as follows:

 6        (105 ILCS 5/27-8.2 new)
 7        Sec. 27-8.2.  Home schools; report of immunizations.
 8        (a)  The parent or guardian of a student in a home school
 9    program  shall notify the county health department, not later
10    than November  15  of  each  calendar  year,  of  the  names,
11    addresses,  and  birthdates  of  all  children  who  are then
12    enrolled as students or receiving  instruction  in  the  home
13    school  program.   The  notice  shall be in writing, shall be
14    signed by the  child's  parent  or  guardian,  and  shall  be
15    accompanied  by  a  copy of a birth, baptismal, or equivalent
16    certificate or record of the child's name and age.
17        (b)  Each  child  enrolled  as  a  student  or  receiving
18    instruction in the home school program shall be  required  by
19    the  parent or guardian to receive such immunizations against
20    preventable communicable diseases and such vision and hearing
21    screening services as the Department of Public  Health  shall
22    require   for  school  children  generally  under  rules  and
23    regulations promulgated by the  Department  pursuant  to  the
24    Communicable  Disease  Prevention  Act,  the Child Vision and
25    Hearing Test Act, and Section  27-8.1  of  the  School  Code.
26    However,  the  parent  or  guardian of a child who objects to
27    immunizations on religious grounds or to vision  and  hearing
28    screening  services  on  constitutional  grounds shall not be
29    required  to  submit  his  or  her  child  or  ward  to   the
30    immunization  or  screening,  nor  shall  an  immunization be
31    required if a physician employed by the parent or guardian to

 1    provide care and treatment  to  the  child  states  that  the
 2    child's physical condition is such that administration of one
 3    or   more   of   the  required  immunizing  agents  would  be
 4    detrimental to the  health  of  the  child.   The  parent  or
 5    guardian  shall  submit  to  the  county health department to
 6    which the notice required by subsection (a) of  this  Section
 7    is  to  be given, not later than November 15 of each calendar
 8    year, proof that each child then enrolled  as  a  student  or
 9    receiving instruction in the home school program has received
10    the  immunizations and screenings required by this paragraph.
11    If a child has not received the immunizations or  screenings,
12    the  child's  parent  or  guardian shall submit to the county
13    health department a signed statement  detailing  the  grounds
14    for   the  religious  or  constitutional  objections  or  the
15    physician's statement that  administration  of  the  required
16    immunizing agent or agents would be harmful to the child.
