 1        AN ACT to amend the Gas Storage Act by  changing  Section
 2    1.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Gas Storage Act is  amended  by  changing
 6    Section 1 as follows:

 7        (220 ILCS 15/1) (from Ch. 96 1/2, par. 5501)
 8        Sec. 1. Any corporation which is engaged in or desires to
 9    engage  in,  the  distribution,  transportation or storage of
10    natural gas or manufactured gas, which gas, in  whole  or  in
11    part,  is intended for ultimate distribution to the public in
12    the  State  of  Illinois,  if  the  said  business  of   such
13    corporation  is  regulated  or  subject  to  regulation under
14    either the laws of the State of Illinois or the laws  of  the
15    United  States,  shall  have the right to enter upon, take or
16    damage private property  or  any  interest  therein,  in  the
17    manner  provided  for by the law of eminent domain, necessary
18    or convenient for its said operations, including the  storage
19    of  gas,  all  of  which operations are hereby recognized and
20    declared to be affected with a public interest and all of the
21    property used in which operations is  hereby  recognized  and
22    declared to be devoted to public use. If a person (i) holds a
23    certificate  of public convenience and necessity issued under
24    the federal Natural Gas Act (that is, under 15  U.S.C.  717f)
25    for  the construction of a pipeline for the transportation of
26    natural gas and (ii) desires to exercise the right of eminent
27    domain as authorized  in  that  Act,  then  the  person  must
28    exercise  that right in a proceeding under Article VII of the
29    Code of Civil Procedure in the circuit court of the county in
30    which the property to be acquired is located.

 1        Section 99.  Effective date.  This Act takes effect  upon
 2    becoming law.
