 1        AN  ACT  to amend the Radiation Protection Act of 1990 by
 2    changing Section 24.5.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The  Radiation  Protection  Act  of 1990 is
 6    amended by changing Section 24.5 as follows:

 7        (420 ILCS 40/24.5)
 8        Sec. 24.5.  Mammography installation; federal  and  State
 9    programs.
10        (a)  The  Department  may, with approval by the Secretary
11    of the U.S. Department of Health and Human Services, exercise
12    the powers, duties, and responsibilities of an  accreditation
13    body  under  the federal Mammography Quality Standards Act of
14    1992.  The Department may promulgate  rules  and  incorporate
15    into  the  rules  standards  that  may  be  necessary for the
16    Department  to  qualify  as  an  accreditation   body.    The
17    Department may, by rule, establish reasonable fees to be paid
18    to   the   Department   by   mammography   installations  for
19    accreditation by the Department.
20        (b)  The Department may  implement  a  State  program  to
21    carry out the certification program requirements provided for
22    in  the  Mammography  Quality  Standards  Act  of  1992.  The
23    Department may promulgate rules and enter into agreements  as
24    necessary  to  implement the provisions of this Section.  The
25    Department rules may, by  rule,  establish  provide  for  the
26    establishment  of a reasonable fees inspection fee to be paid
27    to  the   Department   by   mammography   installations   for
28    certification by the Department.

30        Section  99.  Effective date.  This Act takes effect upon
