 1        AN  ACT  to  amend  the  Criminal  Code of 1961 by adding
 2    Sections 31A-2 and 31A-3.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.  The  Criminal  Code  of  1961  is amended by
 6    adding Sections 31A-2 and 31A-3 as follows:

 7        (720 ILCS 5/31A-2 new)
 8        Sec.  31A-2.  Visitor  to   Department   of   Corrections
 9    facility; false identification.
10        (a)  It   is   unlawful   for  any  visitor  to  a  penal
11    institution of the Department of Corrections to use  a  false
12    identification  card  or  alias  to  gain access to the penal
13    institution.
14        (b)  Sentence.  A person who  violates  this  Section  is
15    guilty of a Class 4 felony.

16        (720 ILCS 5/31A-3 new)
17        Sec.   31A-3.  Criminal  offenses  in furtherance of gang
18    activities.
19        (a)  A criminal offense in furtherance of gang activities
20    that is committed in a penal institution, on the grounds of a
21    penal  institution,  or  within  1,000  feet   of   a   penal
22    institution  must be punished as an offense that is one grade
23    higher than the penalty imposed for the offense.
24        (b)  For purposes of this Section:
25             (1)  "Gang"  has  the  meaning  ascribed  to  it  in
26        Section 10 of the Illinois Streetgang  Terrorism  Omnibus
27        Prevention Act.
28             (2)  "One  grade  higher"  means  that  a  petty  or
29        business   offense   must   be  punished  as  a  Class  C
30        misdemeanor, a Class C misdemeanor must be punished as  a

 1        Class  B  misdemeanor,  a  Class  B  misdemeanor  must be
 2        punished as a Class A misdemeanor, a Class A  misdemeanor
 3        must be punished as a Class 4 felony, a Class 4 felony as
 4        a Class 3 felony, a Class 3 felony as a Class 2 felony, a
 5        Class 2 felony as a Class 1 felony, a Class 1 felony as a
 6        Class  X  felony,  and  a  Class X felony or first degree
 7        murder, if  the  death  penalty  is  not  imposed,  as  a
 8        sentence of natural life imprisonment.
