1 AN ACT to amend the Unified Code of Corrections by
2 changing Section 3-8-8.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Unified Code of Corrections is amended by
6 changing Section 3-8-8 as follows:
7 (730 ILCS 5/3-8-8) (from Ch. 38, par. 1003-8-8)
8 Sec. 3-8-8. Grievances.
9 (a) The Director shall establish procedures to review
10 the grievances of committed persons. The Director may
11 establish one or more administrative review boards within the
12 Department to review grievances. A committed person's right
13 to file grievances shall not be restricted. The procedures
14 Such procedure shall provide for the review of grievances by
15 a person or persons other than the person or persons directly
16 responsible for the conditions or actions against which the
17 grievance is made.
18 (b) Such procedures shall provide that a record of such
19 grievance and any decision made with respect to it shall be
20 preserved for a period of one year.
21 (c) Such procedures shall allow committed persons to
22 communicate grievances directly to the Director or some
23 person designated by the Director outside of the institution
24 or facility where the person is confined.
25 (d) All committed persons shall be informed of the
26 grievance procedures established by the Department and they
27 shall be available to all committed persons.
28 (e) Discipline shall not be imposed because of use of
29 the grievance procedure.
