 1        AN ACT to amend the Private Sewage Disposal Licensing Act
 2    by changing Section 7.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.  The Private Sewage Disposal Licensing Act is
 6    amended by changing Section 7 as follows:

 7        (225 ILCS 225/7) (from Ch. 111 1/2, par. 116.307)
 8        Sec. 7. The Department shall promulgate and  publish  and
 9    may  from  time  to time amend a private sewage disposal code
10    which  shall  include  minimum  standards  for  the   design,
11    construction, materials, operation and maintenance of private
12    sewage  disposal systems, for the transportation and disposal
13    of wastes removed therefrom and for private  sewage  disposal
14    system servicing equipment. In the preparation of the private
15    sewage  disposal  code,  the  Department may consult with and
16    request technical assistance from other state  agencies,  and
17    shall  consult  with  other technically qualified persons and
18    with owners and operators of such services. Such  technically
19    qualified  persons  shall include representatives of the real
20    estate, development, and building industries.
21        The Department is expressly prohibited from amending  the
22    private  sewage  disposal code by rule if there are increases
23    in the land density requirements.  Amendments  that  increase
24    the  land  density  requirements  must  be  approved  by  the
25    Illinois General Assembly.
26        Before  the  adoption  or amendment of the private sewage
27    disposal code, the Department shall  hold  a  public  hearing
28    with  respect thereto. At least 120  20 days' notice for such
29    public hearing shall be  given  by  the  Department  in  such
30    manner  as  the  Department  considers adequate to bring such
31    hearing to the attention of persons interested in such  code.

 1    Notice   of  such  public  hearing  shall  be  given  by  the
 2    Department to those who file a request for a  notice  of  any
 3    such hearings.
