 1                    AMENDMENT TO HOUSE BILL 2283

 2        AMENDMENT NO.     .  Amend House Bill  2283  on  page  2,
 3    line  22,  by  inserting "Henderson, Warren, Morgan, Mercer,"
 4    after "Schuyler"; and

 5    on page 2, line 25,  by  inserting  "Any  territory  that  is
 6    disconnected  from  the Mid-America Intermodal Authority Port
 7    District shall cease to be  under  the  jurisdiction  of  the
 8    Mid-America Port Commission." after "Commission."; and

 9    on page 4, by replacing lines 12 and 13 with the following:

10        "Section  900.  The Mid-America Intermodal Authority Port
11    District Act is amended by changing Section 10 and by  adding
12    Section 172 as follows:

14        Sec.  10.  Mid-America Intermodal Authority Port District
15    created.  There is  created  a  political  subdivision,  body
16    politic,  and  municipal  corporation  by  the  name  of  the
17    Mid-America  Intermodal Authority Port District embracing all
18    the area within the corporate limits of Adams,  Brown,  Cass,
19    Hancock,  Pike,  Schuyler, Henderson, Warren, Morgan, Mercer,
20    and Scott Counties.  Territory may be annexed to the district
21    in the manner provided in this Act.  The district may sue and

 1    be sued in its corporate name but execution shall not in  any
 2    case issue against any property of the district. It may adopt
 3    a common seal and change the same at its pleasure.

 6        Sec.  172.  Disconnection.   The  registered  voters of a
 7    county included in the District may petition the State  Board
 8    of  Elections  requesting  the  submission of the question of
 9    whether the county should be disconnected from  the  District
10    to  the  electors  of  the  county.   The  petition  shall be
11    circulated in the manner required  by  Section  28-3  of  the
12    Election  Code and objections thereto and the manner of their
13    disposition shall be in accordance with Section 28-4  of  the
14    Election  Code.   If a petition is filed with the State Board
15    of Elections, signed by not less than 5%  of  the  registered
16    voters  of  the  county,  requesting  that  the  question  of
17    disconnection be submitted to the electors of the county, the
18    State  Board  of  Elections  must certify the question to the
19    proper election authority, which must submit the question  at
20    a  regular  election held at least 78 days after the petition
21    is filed in accordance with the Election Code.
22        The question  must  be  submitted  in  substantially  the
23    following form:
24             Shall  (name  of  county)  be  disconnected from the
25        Mid-America Intermodal Authority Port District?
26    The votes must be recorded as "Yes" or "No".
27        If a majority of the electors voting on the question vote
28    in the affirmative, the county shall be disconnected from the
29    District.

30        Section 99.  Effective date.  This Act takes effect  upon
31    becoming law.".
