 1        AN  ACT  to  amend  the Illinois Vehicle Code by changing
 2    Sections 12-205.1 and 12-709.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The  Illinois  Vehicle  Code  is amended by
 6    changing Sections 12-205.1 and 12-709 as follows:

 7        (625 ILCS 5/12-205.1) (from Ch. 95 1/2, par. 12-205.1)
 8        Sec. 12-205.1. Implements  of  husbandry  or  slow-moving
 9    vehicles-Display  of  amber  signal  lamp. Every animal drawn
10    vehicle, farm tractor, implement  of  husbandry  and  special
11    mobile  equipment,  except when used for road construction or
12    maintenance  within  the  limits   of   a   construction   or
13    maintenance project where traffic control devices are used in
14    compliance  with  the applicable provisions of the manual and
15    specifications adopted under Section 11-301 of  the  Illinois
16    Vehicle  Code,  when operated on a highway during a time when
17    lighted lamps are required by Section 12-201 of this Chapter,
18    shall display to the rear at least one flashing amber  signal
19    lamp  mounted  as  high  as  practicable  and  of  sufficient
20    intensity  to  be visible for a distance of at least 500 feet
21    in normal sunlight; provided, that only the rearmost  vehicle
22    of  a  combination  of vehicles coupled together need display
23    such lamp. The flashing amber signal  lamp  may  be  operated
24    lighted  during  daylight  hours  when  other  lamps  are not
25    required to be  lighted  when  vehicles  authorized  in  this
26    Section  are  operated  on a highway. Implements of husbandry
27    manufactured on or after January  1,  2003  and  operated  on
28    public   roads  between  sunset  and  sunrise  shall  display
29    markings  and  lighting  that  meet  or  exceed  the  design,
30    performance,  and  mounting  specifications  adopted  by  the
31    American Society of Agricultural Engineers and  published  by

 1    that body as ASAE S 279.10 APR98.

 4        Sec. 12-709. Slow-moving vehicle emblem.
 5        (a)  Every  animal drawn vehicle, farm tractor, implement
 6    of husbandry and special mobile equipment, when operated on a
 7    highway must display a slow-moving vehicle emblem mounted  on
 8    the rear except as provided in paragraph (b) of this Section.
 9    Special  mobile  equipment is exempt when operated within the
10    limits of a construction or maintenance project where traffic
11    control devices are used in compliance  with  the  applicable
12    provisions  of  the  manual  and specifications adopted under
13    Section 11-301 of the "Illinois Vehicle Code".
14        (b)  Every vehicle or unit described in paragraph (a)  of
15    this  Section  when operated in combination on a highway must
16    display a slow-moving vehicle emblem as follows:
17             1.   Where  the  towed  unit  or  any  load  thereon
18        partially or totally  obscures  the  slow-moving  vehicle
19        emblem  on  the  towing  unit,  the  towed  unit shall be
20        equipped with a slow-moving vehicle emblem. In such cases
21        the towing unit need not display the emblem.
22             2.  Where the  slow-moving  vehicle  emblem  on  the
23        towing  unit  is  not  obscured  by the towed unit or its
24        load, then either  or  both  may  be  equipped  with  the
25        required  emblem  but  it  shall  be sufficient if either
26        displays it.
27             3.  A registered truck towed behind a  farm  tractor
28        in  conformity  with the provisions of Section 11-1418 of
29        the "Illinois Vehicle Code" must  display  a  slow-moving
30        vehicle  emblem  in  the manner provided in paragraph (c)
31        while being towed on a  highway  if  the  emblem  on  the
32        towing vehicle is partially or totally obscured.
33        (c)  The   slow-moving   vehicle   emblem   required   by

 1    paragraphs  (a)  and  (b)  of  this  Section  must  meet  the
 2    specifications  and  mounting requirements established by the
 3    Department. Such  specifications  and  mounting  requirements
 4    shall  be based on the specifications adopted by the American
 5    Society of Agricultural Engineers and published by that  body
 6    as  ASAE  S  276.2  dated  March, 1968 or as ASAE S 276.5. No
 7    advertising or other marking shall  appear  upon  the  emblem
 8    except that specified by the American Society of Agricultural
 9    Engineers  to  identify  the  standard  to which the material
10    complies.  Each original  package  containing  a  slow-moving
11    vehicle  emblem  shall display a notice on the outside of the
12    package stating that such emblem shall only be used  for  the
13    purposes stated in subsections (a) and (b).
14        (d)  A slow-moving vehicle emblem is intended as a safety
15    identification  device  and  shall  not  be  displayed on any
16    vehicle nor displayed in any manner other than  as  described
17    in  paragraphs (a), (b) and (c) of this Section.  A violation
18    of this subsection (d) is a petty  offense  punishable  by  a
19    fine  of  $25  for  the first offense and $75 for a second or
20    subsequent offense within one year of the first offense.
