1 AMENDMENT TO HOUSE BILL 2023
2 AMENDMENT NO. . Amend House Bill 2023, AS AMENDED,
3 by replacing the title with the following:
4 "AN ACT to amend the Environmental Protection Act by
5 adding Section 58.15."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Environmental Protection Act is amended
9 by adding Section 58.15 as follows:
10 (415 ILCS 5/58.15 new)
11 Sec. 58.15. Construction of educational facility;
12 requirements. No person shall commence construction on real
13 property of a building intended for use as an educational
14 facility for children 18 years of age or younger unless:
15 (1) a Phase 1 Environmental Audit, conducted in
16 accordance with Section 22.2 of this Act, is obtained;
17 (2) if the Phase 1 Environmental Audit discloses
18 the presence or likely presence of a release or a
19 substantial threat of a release of a regulated substance
20 at, on, to, or from the real property, a Phase II
21 Environmental Audit, conducted in accordance with Section

1 22.2 of this Act, is obtained; and
2 (3) if the Phase II Environmental Audit discloses
3 the presence or likely presence of a release or a
4 substantial threat of a release of a regulated substance
5 at, on, to, or from the real property, the real property
6 is enrolled in the Site Remediation Program and remedial
7 action that the Agency approves for the intended use of
8 the property is completed.".
